Dear Mr. Orlando:

During our June 16,1998 meeting BWXT and ARCO agreed to develop a plan to address the public involvement requirements of 10CFR20.1403(d) and submit the plan to the NRC for review and comment. Accordingly, enclosed please find our Community Advisory Panel (CAP)

- Action Plan.

It is our intent to review the CAP-Action Plan, along with other elements of our public participation progra.m, with members of the NRC staff during our forthcoming meeting scheduled for May 20,1999. A proposed agenda for the meeting will be forwarded under separate cover.

PARKS SHALLOW LAND DISPOSAL AREA Action Plan for Establishing Community Advisory Panel under 10 CFR 20.1403(d)

I. Overview ARCO Environmental Remediation LLC (" ARCO") and BWXT intend to modify their existing community relations plan by establishing a Community Advisory Panel (CAP) to provide local public input into the Decommissioning Plan (DP) for BWXT's license for the Shallow Land Disposal Area (SLDA)in Parks Township, Armstrong County, Pennsylvania.

The CAP and its evaluation ofissues related to the DP shall be carried out pursuant to the authority set forth in 10 CFR 20.1403(d). This rule requires Atomic Energy Act licensees who propose to decommission licensed facilities under restricted conditions to seek public advice on their proposed institutional controls.

The purpose of the advisory panel will be:

to seek input from a diverse cross-section of the community that may be affected by the e

decommissioning; to provide a forum for meaningful public discussion of decommissioning issues,

)

e especially those relating to institutional controls and financial assurances for the SLDA.

II. Organization and Function 1

a. The CAP shall be responsible for soliciting public input and providing comment on the DP, and the institutional controls and financial assurances proposed by ARCO /BWXT.
b. The CAP will consist of no more than 12 representatives, including at least one person from each of the following groups:

- Adjacent property owners

- Parks Township Supervisors

- Parks Township law enforcement

- Armstrong County government

- Local Chamber of Commerce

- Neighboring industry

- Kiski Area School Board

- Sportsmen's clubs / service organizations 04/29/99 j

c. Members of the advisory board will not be paid. ARCO /BWXT will reimburse members' reasonable and necessary expenses incurred in performance of their duties.

d.^ The members of the advisory panel will elect a chairperson, vice chairperson and secretary. Specific responsibilities of those officers will be contained in the operating procedures to be established by the CAP. Draft operating procedures shall be furnished to the CAP by ARCO /BWXT for review and adoption by the CAP.

e. The CAP will hold its meetings at a handicapped-accessible meeting facility within Armstrong County. The times and dates of these meetings will be determined

- by the CAP in accordance with the operating procedures. The method for scheduling l

and holding these meetings will be included in the operating procedures.

f. The meetings will be advertised in published media and will be open to the public.
g. Members of the public will be given an opportunity to speak at all meetings. The i

CAP will establish procedures for the public to address the panel.

h. ARCO /BWXT will provide the CAP with a timetable for completing various tasks and will provide prioritized substantive agendas for each meeting. The CAP may address matters not on an ARCO /BWXT agenda, but if the CAP fails to address a matter with respect to which ARCO /BWXT face an NRC deadline, CAP inaction shall not constitute cause for delay in the action subject to the deadline. The CAP timetable and deadlines may be modified by ARCO /BWXT as necessary to meet NRC requirements.
i. ARCO /BWXT shall provide reasonable secretarial and other administrative l

resources, and necessary equipment for the CAP, and shall pay the reasonable rental costs of meeting rooms, notices, publicity, document storage, facilitator's fees, and

other reasonable and necessary expenses of the CAP.

j. ARCO /BWXT will provide an independent, professional facilitator to assist the panel in conducting meetings, to serve as a liaison between the companies and the panel, and to provide other professional support needed by the CAP.
k. ARCO /BWXT will evaluate all of the suggestions offered by the CAP. Where appropriate, those suggestions will be incorporated into the DP. ARCO /BWXT will provide reasons for its decisions regarding any of the suggestions not incorporated into j

the DP.

1. The CAP shall maintain a file of all documents it receives and produces, and such file shall be available for public review at reasonable hours on a regular basis.

n lJo III. Soliciting Panel Members ARCO /BWXT will be responsible for soliciting membership on the CAP and ensuring the membership is representative of the community affected by the decommissioning process.

Members of particular govemment agencies and community organizations will have the opportunity to choose a qualified representative. The individual chosen to represent a given sector of the community must be willing and able to perform the tasks assigned to the CAP and to follow the operating procedures and panel agreement.

To most effectively solicit participation, ARCO / BWXT will prepare an invitation and information packet for distribution to potential advisory panel members. Elements of this package will include:

-- An introductory message from the project manager giving a brief overview of the project and explaining the role that the CAP is expected to play in the public involvement process.

-- A fact sheet on the composition and responsibility of the advisory panel.

This will include a description of the role an independent facilitator will play in this process.

-- A letter of agreement to be signed by panel members. Through the agreement, advisory panel members acknowledge the role of the CAP and express their understanding of the process to be followed. The agreement shall require thai all members agree to participate in a cooperative and productive manner, and that members who conduct themselves in an unruly or disruptive manner at meetings shall be removed from the panel by a majority vote of the CAP.

- A request to respond by phone within 14 days of receipt of the letter.

This package ofinformation will be presented during an informal and personal meeting between ARCO /BWXT personnel and the prospective panel member. ARCO /BWXT may

. also hold discussions with the leadership of the above-mentioned sectors of the community to inform them of the CAP process and allow them to select the most appropriate representative.

IV. Selectine the Independent Facilitator An independent facilitator will be utilized as an important resource in ensuring the CAP's ability to move forward with its tasks in a productive and organized manner. The facilitator shall be compensated as a component of the overall CAP expense budget.

The facilitator's role will be to serve as the liaison between the CAP and ARCO /BWXT, assist I

_ responsible for running the meetings and coordinating the panel's activities.

The facilitator shall not be directly affiliated with ARCO /BWXT, and may be chosen by ARCO /BWXT from an organization that provides mediation or facilitation services. He or she should have experience with similar projects and experience with conflict management.

V. Schedule

. The draft operating procedures provided by ARCO /BWXT to the CAP shall contain a schedule for the CAP's activities. Any schedule is subject to NRC requirements, so

- ARCO /BWXT may adjust the schedule as necessary or appropriate to meet NRC demands and timetables.
