Dear Members of the Appeal Board:

Counsel for the NRC staff has been advised by counsel for the State of Illi-nois that the State intends to file a response under the provisions of 10 C.F.R. Section 2.762 to the Brief of US Ecology, Inc. [USE] in Support of its Appeal of the Final Decision (March 16, 1987).

Based upon the State counsel's literal interpretation of Section 2.762, the Staff calculates that the State's brief is to be filed by June 1, 1987.

This date was derived as follows:

March 12,1987 - Service of Memorandum and Order (Clarifying Finality i

of Decision);

March 27, 1987 - Date by which parties permitted to file notices of appeal; April 27, 1987 - Date by which appellants may file briefs in support of their appeals; and June 1,

1987 - Date by which State may file brief in response to appellants' briefs.
