Dear Mr. Titzer:
This is to acknowledge receipt of your letter dated March 25, 1993, providing the NRC Region III office with additional information regarding a missing nuclear ionizer gun. The device, Model Number P-2051 and Serial Number 47563, was leased from Nuclear Radiation Development, Inc. and contained a nominal 10 mil 11 curies of Polonium-210.
We have concluded that you are in violation of NRC regulations as specified in i
10 CFR 31.5(c)(8) which require, in part, that a generally licensed device be transferred only to persons who are authorized by a specific license issued by the NRC (or an Agreement State) to receive the device. A copy of 10 CFR Part 31 is enclosed for your review. The unauthorized trt.nsfer and disposal of the devices constitutes a violation of NRC requirements as described in the enclosed Notice.
During the past three years, you have reported the loss of three ionizer guns containing licensed material. Consequently, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," contained in 10 CFR Part 2, Appendix C, this violation would normally be categorized at Severity Level III with the possible imposition of a civil penalty. However, given the relatively low safety significance of the losses due to the small quantity of radioactive material present in each device, and the fact that you no longer possess nuclear ionizer guns and do not intend to possess any in the future, the violation is categorized at a Severity Level IV.
The violation demonstrates the importance of maintaining adequate control of j
all radioactive material to ensure that improper handling or disposal does not occur.
Since you no longer possess or intend to possess licensed material, however, no reply to the violation is required and we have no further questions regarding this matter.
If your current situation changes and licensed material is needed, you are hereby required to submit a written statement to the U.S. Nuclear Regulatory Commission, Region III, 801 Warrenville Road, Lisle, Illinois 60532-4351, within 30 days prior to receiving licensed material. This reply should discuss the controls which you will institute to prevent future losses of sources.
