Dear Mr. Johnson:
I am responding to your letter of March 30,1999, requesting a public comment period on SECY-99-057, regarding decommissioning criteria for West Valley. The Commission appreciated the participation and views of your agency at the Commission meeting held on January 12,1999. Staff papers are not routinely made public while under Commission consideration. Therefore, there is no public comment period associated with them. However, the Commission decided in the case of West Valley to make the staff papers available to the public to foster open communication on these important matters. The Commission believes that it now has enough information to act on SECY-98-251 and SECY-99-057, so we are not providing an additional formal public comment period at this time. However, you are welcome to submit comments at any time for further Commission consideration. The Commission expects to issue a decisien on the staff papers in the near future and we willinform your agency of that decision.
