July 1, 1986 ORDER (Denying SXPE Motion To Dismiss The Application For Unit 2)

On June 10, 1986, SAPL filed Motion To Dismiss Application For Unit 2; Applicants on June 25 and NRC Staff on June 27 opposed.

For all the reasons stated by this Board in 1983/4 when this same Motion was filed by SAPL and its surrogate, the present Motion is denied. For the.easons the Appeal Board affirmed the Licensing Board inALAB-758,19NRC7(January 24,1984), the present Motion is denied and for the reasons stated by the Appeal Board in ALAB-762 at 569-70, the present motion is denied.
