20555 Centlement The purpose of this letter is to inform the Nuclear Regulatory Commission (NRC) that Toledo Edison is delaying implementation of the ATWS rule (10 CFR 50.62) in accordance with the guidance given in an NRC letter from Mr. A. W. DeAgazio dated March 10, 1987 (Log No. 2243). That letter allowed Toledo Edison to delay implementation of the ATWS rule require-ments to no later than the third refueling outage after July 24, 1984.
As stated in the March 10, 1987 Ictter, the NRC review of generic ATWS designs have either only recently been completed or are still ongoing.
The NRC review of the generic ATWS design applicable to Davis-Besse (Babcock & Wilcox Owners Group) has not yet been completed. Pending completion of the NRC review of the B&W owners Group design requirements in the near future, Toledo Edison will implement the ATWS rule require-ments by the end of the Davis-Besse sixth refueling outage.
