OMB SUPPORTING STATEMENT FOR QUESTIONNAIRE REGARDING THE TENNESSEE VALLEY AUTHORITY'S NUCLEAR SAFETY REVIEW STAFF REPORTS AND NRC STAFF Description of the Information Collection The U.S. House of Representatives Subcommittee on Oversight and Investigations is currently conducting a legislative oversight inquiry into certain matters involving NRC and the Tennessee Valley Authority (TVA). Congress-man John Dingell, Chairman of the Subcomittee, has requested the Chairman, NRC, to obtain under oath or by sworn affidavit certain information concerning reports prepared by TVA's Nuclear Safety Review Staff (NSRS).

A. JUSTIFICATION 1.

Need for the Collection of Information. The U.S. House of Representa-tives Subcommittee on Oversight and Investigations has requested infomation concerning TVA's NSRS reports.

In order to fulfill this requirement, NRC needs to obtain certain infomation from NRC and TVA employees who have knowledge of NSRS reports.

2.

Agency Use of Information. The information to be collected will be reviewed and analyzed by NRC's Office of Inspector and Auditor (OIA).

The results of 01A's analysis will then be forwarded in report form to Congressman Dingell.

3.

Reduction of Burden Through Information Technology. There are no legal or technical obstacles to reducing the burden associated with this information collection; however, it is not feasible to reduce the burden below its current level.

Effort to Identify Duplication. To our knowledge this information does not exist in any public source. The NSRS was an internal TVA organiza-1 tion and was not required to provide reports outside TVA.

Effort to Use Similar Information. The House Subcomittee has requested specific information regarding the availability of NSRS reports to NRC staff. To our knowledge, there is no similar information that can be i

used to satisfy the Congressional request.

6.

Effort to Reduce Small Business Burden. The information requested does not apply to or involve small businesses or other small entities.

7.

Consequences of Less Frequent Collection. This question does not apply to our collection of information because it is not perfomed on a continuing routine basis.

Circumstances Which Justify Variation From OMB Guidelines. The informa-l tion is requested for use by the Subcommittee as part of their inquiry of

TVA and NRC. The information is not for u'se by NRC as part of its regulatory oversight.

9.

Consultation Outside the NRC. OIA has written to the Manager of Nuclear Power, TVA, requesting his assistance in providing names and addresses of members of NSRS who have left TVA or are still employed at TVA. No other persons outside the Agency have been consulted to obtain their views on i

the availability of the data because it is not known which former NRC staff and TVA staff may have had access to the NSRS reports and/or i

provided NSRS reports to NRC personnel.

10. Confidentiality of Information. NRC provides no pledge of confiden-tiality for this collection of information.
11. Justification for Sensitive Questions. No sensitive infomation is being requested.
12. Estimated Annual Cost to the Federal Government. There is no way to make a reasonable estimate of annual cost to the Federal Government because i

the number of potential Federal employees who may have knowledge regard-ing the NSRS reports have differing pay grades and their level of effort to respond to our questionnaire has not been determined.

In addition, i

some responses may require follow-up by personal interview. However, this collection of information is a one time effort by NRC to answer the concerns of Congressman Dingell, f

13. Estimate of Burden. The estimated burden for the collection of this Infomation is about 50 staffhours for fomer NRC employees and current i

and former TVA employees. We estimate one-half hour per person to i

respond to the questionnaire.

Former NRC Employees. We estimate there are approximately 80 former NRC staff who may have information. Therefore, the estimated burden for this i

group is 40 staffhours (80 x 1/2).

We estimate there are approixmately 20 current and former TVA staff who may have information. Therefore, the estimated burden for this group is 10 staffhours (20 x 1/2),

We are only interested in arrangements entered into prior to January 1, 1985.

I In order to assist us in our inquiry, we have prepared the attached questionnaire that you are requested to complete. The purpose of this questionnaire is to ascertain the number of employees who may have provided and/or made available NSRS reports to NRC and the estimated time it may take you to review your records to verify certain facts regarding the NSRS reports.

We are not requesting that a detailed search of records be conducted at this time for the purpose of this questionnaire. Therefore, for those individuals who know they have provided NSRS report (s) to NRC or need more time to make such a determination, we will follow up with another questionnaire that addresses the specific concerns of Congressman Dingell. The follow-up questionnaire will require you to provide information regarding, but not limited to, the identification of NSRS reports, regulatory issues identified in the reports, resolution of issues, and the NRC staff to whom NSRS reports were provided and/or made available.
