Transcript of Tuesday, March 25, 1986, in the matter of Public Service Company of New Hampshire, et al.,
Docket No. 50-443-OL.
I have reviewed pages 2098-2099 of the above-cited transcript, as requested.
My stenotype notes reveal the following:
Page 2098:
No change.
Page 2099, lines 2-5, should read:
" JUDGE H0YT:
Mr. --
"MR.
BACKUS:
Madam Reporter, would you please
{ indicate} the chairman is forbidding me to make a statement on the record.
I will go on.
" JUDGE H0YT:
No, sir, you will not.
You will continue, Mr. Backus.
We will consider your argument.
The reporter is to strike that comment from the record.
Do you wish to continue or do you wish to cease at this point?"
At the time I reported the above-cited pages, Judge Hoyt and Mr. Backus were speaking at the same time, which is not an unusual situation for a stenotype reporter, and a reporter can usually " carry" both speakers and record them both stenotypically, if the exchange is brief.
However, in the above-re fe renced case, this was impossible.
In the statement by Mr. Backus, the word " indicate" is in brackets, to indicate that the word is not in my stenotype notes, but it is the most logical word which would make grammatical sense of that sentence.

Backus' statement, and which are indicated above in the corrected version of the transcript, were deliberately omitted because of Judge Hoyt's direction to the reporter, also cited above:
"The reporter is to strike that comment from the record."
The NRC Contract No. NRC-21-85-401, which covers the shorthand reporting requirements of the NRC, states:
"Everything spoken during a hearing shall be reported and incorporated into the transcript unless the Presiding Officer otherwise directs."
Because Judge Hoyt directed me to "
strike that comment from the record.", I did.
The digital tape has been erased.
