ENFORCEMENT DISCRETION

On October 30,1998, the NRC completed an inspection at the Clinton Power Station. The

purpose of this inspection was to review actions taken by your engineering organization to

,

resolve fire protection safe shutdown concems identified as NRC Case Specific Checklist

Matrix Item IV.S. The enclosed report presents the results of that inspection.

The inspection team concluded that your fire protection re-validation project was

(

comprehensive and that significant progress has been made in addressing safe shutdown

!

concems identified during the NRC Special Evaluation Team inspection conducted in

l

. August 1997. In addition, the inspectors determined that the Clinton 10 CFR 50, Appendix R

re-validation project sufficiently demonstmted that the revised Appendix R safe shutdown

l

analysis complies with the Clinton licensing basis. However, based on a review of the status

l-

of your efforts to address Case Specific Chet.klist Matrix item IV.5, the team concluded that

!

additional work remained before the item was ready for closure by the NRC. These issues,

,

i

which are discussed in the enciesed report, need to be corrected by your staff and reviewed by

the NRC prior to the restart of the Clinton Power Station.

Your fire protection staff identified violations of 10 CFR Appendix R requirements during

j

ongoing fire protection re-validation efforts. These requirements were established to protect or

enable operations of safe shutdown equipment. These violations demonstrates that a

postulated fire could damage equipment in an area such that safe shutdown could not be

achieved and maintained using the applicable equipment in the fire hazards analysis. These

. violations were caused by design control problems which were some of the causes that

'

resulted in the current plant shutdown. One violation pertained to the failure to protect motor

operated valves from fire induced mechanica1 damage and the second violation contained

'

three examples of a failure to provide adequate electrical circuit isolation for several safe

l

shutdown componeng g 3

However, I have been authorized, after consultation with the Director, Office of Enforcement

j

and the Acting Regional Administrator, to exercise enforcement discretion for these Severity

Shutdowns or Work Stoppages," of NUREG 1600, " General Statement of Policy and

Procedures for NRC Enforcement Actions" (Enforcement Policy), and not issue a Notice of

Violation for these issues.

The decision to apply enforcement discretion was based on consideration of the following:

(1) the violations were licensee-identified as part of a comprehensive program for problem

identification and correction that was developed in response to the shutdown, in the fire

protection area; (2) significant NRC enforcement action was previously taken against the

Illinois Power Company for design control problems; (3) additional enforcement action was not

considered necessary to achieve remedial action for tbn violation due to Clinton Power

Station's commitment in its Fire Protection Plan for Excellence to take actions to address fire

protection design control issues before a plant restart; (4) these violations were related to

problems that were present before the events leading to the shutdown; (5) the violations were

not classified at a severity level higher than Severity Level 11; (6) the violations were not willful;

and (7) Clinton Power Station must provide reasonable assurance that safe shutdown

systems, structures and components will perform their intended functions as described in the

design and licensing basis before a plant restart. Effective corrective actions for these

violations will need to be demonstrated before a plant restart.

In accordance with 10 CFR 2.700 of the NRC's " Rules of Practice," a copy of this letter and the

enclosure will be placed in the NRC Public Document Room.
