Dear Mr. Larsen:

We have been advised by Staff ceansel in this proceeding that you have not received certain of the documents filed in this proceeding, and in particular our Memorandum and Order (Response to Order Revoking License),

dated October 26, 1988 That Memorandum and Ceder called upon you to file, no later than November 21, 1988, a response to the Staff's Order Revoking Licenses, dated August 15, 1988, setting forth the matters of fact and law on which you are relying in order to demonstrate that the Staff's Order should not be upheld.

A party to an NRC proceeding has an obligation, of course, to keep NRC informed of the current address at which he can be reached. Notwithstanding your failure thus far to adhere to your obligition in this regard, the Board has decided to provide you another chance to file a response to the Sta f f's Order Revoking Licenses. This response should be filed within 20 days of service of this letter--taking into account mailing time, your response should be filed (mailed) no later than December 27, 1988. The Staff may file a reply to your response no later than 10 days following service of your response. (As we stated earlier, to the extent your response incorporates matters set forth in your letter of March 18, 1988 to the Staff, you need not repeat those matters but may incorporate them by reference, if you 50 choose.)

l (1) Establishment of Atomic Safety and Licensing Board, dated October 24, 1988; (2) Memorandum and Order (Response tu Order Revoking Licenses), dated October 26, 1988; (3) Letter from NRC Staff counsel to Licensing Board members, dated November 4, 1988, enclosing background documents requested by us in our October 26, 1988 Memorandum and Order. (All attachments to th6t letter are also enclosed, except for #6, which is your letter to the Staff of March 18, 1988);

(4) A copy of 10 C.F.R. Part 2, the NRC Rules of Practice which govern this proceeding,

Following our receipt of the Staff's reply to your response, we will schedule a prehearing conference to consider the nature and scope of your claims and your need for discovery. This conference will either be held in Utah or, if matters to be determined are not too complex, could possibly be undertaken through a telephone conference call (at Government expense), which would be taken down verba tim by a professional court reporter (also at Government expense). The prehearing conference could still possibly be scheduled for late January or early February, 1989. The hearing itself would be held in Utah some time thereafter (depending in part on the amount of discovery which you may seek).

We trust that this information will be useful to you in planning for the hearing which you have requested.
