May 11,1999 STATE OF UTAH'S PARTIAL MOTION TO STRIKE APPLICANT'S RESPONSE TO MOTION TO COMPEL In responding to the State's Motion to Compel with respect to discovery on Contention H, the Applicant has agreed to answer the State's interrogatories, but continues to refuse to answer the State's document production requests, on grounds of irrelevance and overbreadth. Applicant's Response to State of Utah's Proprietary and Non-Proprietary Motions to Compel Applicant to Respond to State's First Set of Discovery Requests (May 7,1999) (" Applicant's Response"). Applicant also characterizes the document production requests as " burdensome." Id. at 9. However, the Applicant's April 21,1999 Objections and Proprietary Responses to State's First Requests for Discovery made no initial objection to the discovery on grounds of burdensomeness. Therefore, no 3:uch objection can be made at this late juncture.
Accordingly, the alleged burdensomeness of the discovery should not be taken into account in ruling on the State's Motion to Compel, and the word " burdensome" l
