Dear Ms. Dandolf:
On behalf of GTS Duratek, I request pro-rated adjustment of our 1998 Annual Materials Fee to reflect our status change effective February 1998.
In coordination with Ms. Eng, Section Chief, Transponation and Storage Inspection Section, Spent Fuel Program Office = i her staff, we achieved a status change from 10B(1), " Users and Fabricators" to 10B(2) "Usus" as defined in Tn.e io, Code of Federal Regulations, Part 171.16.
l Our statements and representations were verified by her Branch concluding that GTS Duratek was not currently a
.J holder of a Certificate of Compliance for Radioactive Materials Packages and has not been since February 1998.
This Branch accepted our statements and representations that we have not performed design, fabrication, or modification activities with regard to NRC licensed or regulated packaging (10 CFR 71) since well prior to February 1998. Funher, that we have no plans to initiate other than activities consistent with ' User' status.
' GTS Duratek has not applied their quality system to other than user only responsibilities. Our acquisition of The Scientific Ecology Group (SEG) did not include packages and package certificates sold earlier by Westinghouse Electric Company (SEG) to Molten Metal Technologies. In cooperation with Molten Metal Technologies the majority of those Certificates were effectively transferred in 1997. Due to an oversight, formal transfer of the last j
Certificate of Compliance held by SEG was accomplished in February 98. Thus, a pro-rated fee adjustment based on j
this February 98 final resolution is believed a reasonable request.
