OMB SUPPORTING STATEMENT FOR REPORTING REQUIREMENTS UNDER 10 CFR PART 4
" NONDISCRIMINATION IN FEDERALLY ASSISTED COMMISSION PROGRAMS" Description of the Information Collection Requirements The Rehabilitation Act of 1973, as amended, prohibits discrimination against qualified handicapped individuals under programs or activities receiving Federal financial assistance. In Executive Order 11914, dated April 28, 1976, the President directed that all Federal agencies providing financial assistance issue regulations consistent with standards and procedures to be established by the Secretary of Health and Human Services (HHS). The HHS guidelines were published on January 13, 1978 (43 FR 2131), and are codified at 45 CFR Part 85. 10 CFR Part 4 sets out an NRC program that fulfills the agency's responsibilities under Executive Order 11914.
A. JUSTIFICATION
- 1. Need for the Collection of Information. The reporting and record-keeping requirements are necessary in order for the NRC staff to assure that recipients of Federal financial assistance (agreement states) are in compliance with the Rehabilitation Act of 1973. All of the reporting requirements are modeled after HHS regulations.
- 2. Use of Information. Section 4.32 requires recipients to maintain and submit, when necessary, complete and accurate compliance records.
Section 4.125(d) requires that information obtained by a recipient-employer as to the medical condition or history of an applicant for employment shall be collected and maintained for review by U.S.
Government officials investigating compliance with the Rehabilitation Act of 1973.
Section 4.127(d) requires that, where structural changes to facilities are necessary to render a Federally assisted program accessible to and usable by handicapped persons, a transition plan is to be developed, approved by NRC, and maintained by recipients for public inspection.
Section 4.231(a) requires that applicants submit an assurance that that program will be operated in compliance with this subpart.

a Section 4.231(e) requires that recipients perform self-evaluations of policies and practices that are covered by Section 504 of the Rehabilitation Act of 1973, as amended, to assure that their programs are in compliance with the law. This self-evaluation is to be done with the assistance of interested persons, inc,luding handicapped persons and/or their representatives. Should this self-evaluation' reveal practices or policies that do not comply with NRC regulations, these must be modified and remedial steps taken to eliminate the effects of past discrimination. The self-evaluations shall be maintained on file for public and/or NRC inspection for a period of three years.
- 3. Reduction of Burden Through Information Technology. There are no legal obstacles to reducing the burden that sometimes is associated with similar types of information collection; however, the collection requirements are so minimal, approximately 5 minutes per file for 28 recipients which each maintain an estimated ten files, that there is no need for use of information technology.
- 4. Efforts to Identify Duplication. There is no source for the required information other than the recipients.
- 5. Efforts to use Similar Information. There is no other similar information available.
- 6. Efforts to Reduce Small Business Burden. The information collection does not involve small omsinesses or other small entities.
l 7. Consequences of Less Frequent Collection. The required information is submitted as required. There is no specific timeframe for l
collection.
- 8. Circumstances which Justify Variation from OMB Guidelines. There is no variation from OMB guidelines.
- 9. Consultations Outside the NRC. On May 8, 1979, the NRC published a proposed rule to implement the Rehabilitation Act of 1973, as amended. The language of that rule was very similar to HHS {
guidelines. After considering pu~olic comments on the proposed rule '
and consulting with HHS, the NRC staff revised the proposed rule in several respects. The reporting requirements were determined by HHS to be the most practicable and effective means of assuring compliance with Section 504.

- 10. Confidentiality of Information. NRC provides no pledge of confidentiality for the collection of this infonnation. However, records maintained per 54.125(d) are considered confidential medical records and are maintained as such.
- 11. Justification for Sensitive Questions. In every case information pertaining to handicapping conditions is required in order to assure compliance with Section 504 of the Rehabilitation Act of 1973, as amended.
- 12. Estimated Annualized Cost to the Federal Government. The collection of information will require an annual four hours of professional staff time at $60.00 an hour and one hour of clerical staff time at
$20.00 an hour for a total ennual cost of $260.00.
- 13. Estimate of Burden. The NRC believes that all current recipients conduct programs which are accessible to and usable by the handi-capped and that structural changes will not be necessary to demonstrate compliance with the provisions of Section 504. Thus, the NRC estimates that the requirements of Section 4.127(d), that recipients submit a transition plan and maintain the plan for inspection, will not result in any burden since no new plans are expected to be prepared or maintained. However, the Commission desires this section to be cleared in order to conform to HHS guidelines and in case a future recipient were to require a transition plan.
The recordkeeping requirement of Section 4.125(d) is estimated to impose an annual burden of 5 minutes per file (individual).
Twenty-eight recipients which each maintain an estimated ten files.
Thus, the total annual burden for all recipients is estimated to be l approximately 23 staff-hours.
Section 4.231(a) requires that applicants submit an assurance that the program will be operated in compliance with this subpart.
Under Section 4.231(e), each of the 28 recipients will spend an I average of 900 staff hours preparing a self-evaluation. This will result in a one time burden of 25,200 staff-hours. !
In addition, the maintenance of this self-evaluation will add an average burden of 5 minutes annually for each recipient. Thus the burden for all recipients under Section 4.231(e) will be approximately 25,202 staff-hours for the first year and 25 l staff-hours annually beginning with the second year. i l
