Commonwealth Edison Company (EA 88-198)
(Braidwood Units 1 and 2)
Docket Nos. 50-456 and 50-457
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars
($75,000) will be issued on or about November 23, 1988 to Comonwealth Edison Company. This action is based on a number of failures to adequately implement the environmental qualification requirements of 10 CFP. 50.49.
Because both units were licensed after November 30, 1985 this enforcement action is proposed under the guidance of 10 CFR Part 2, Appendix C rather than the "Modified Enforce-ment Policy Relating to 10 CFR 50.49 " The escalation and mitigation factors of the Enforcement Policy were considered and 50% i..;alation of the base civil penalty was deemed appropriate because the licensee's corrective actions were not timely.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice November 23, 1988 Telephone Notification of Licensee November 23, 1988 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty iray be remitted, mitigated, or imposed by Order.
