The purpose of this modification is to (1) incorporate the within-scope work to the subject contract as referenced in the Statement of Work (ATTACHMENT 1) and the 1 contractor's proposal dated 3/11/99 is incorporated herein (NOTE: The date for the Peer Review Panel Meeting P. in Oakland,' CA for,8/15/99 is revised to 8/17/99), (2) increase th'e contract ceiling amount by $303,478 from $909,056 to $1,212,534, (3)
~ increase the oblig"ated amount by $150,00.00 from $909,056 to $1,059,056, and (4) extend the period of performance of the contract through 8/31/2000. NOTE: The period from 7/2/2000 through 8/31/2000 is to allow time for NRC to address issues pertaining to the publication of the report on the trail application of the procedures.
Accordingly, the contract is hereby modified as follows:
1.
Section B.3, CONSIDERATION AND OBLIGATION-COST PLUS FIXED FEE (JUNE 1988) ALTERNATE I (JUNE 1991), paragraphs a, b, and c are deleted in their entirety and the following paragraphs are substituted in lieu thereof:
"a.
The total estimated cost to the Government for full performance of this contract is $1,212,534, of which the sum of $1,206,737 represents the estimated reimbursable costs, and of which $5,797 represents the fixed fee,
- b. The amount currently obligated by the Government with respect to this contract is $1,059,056.
c.
It is estimate that the amount currently allotted will cover performance through 11/30/99."

Section F.6, DURATION OF CONTRACT PERIOD, is deleted in its entirety and the following paragraph is substituted in lieu thereof:
"This contract shall commence on 4/4/96 and will expire on 8/31/2000."
All other terms and conditions under this contract remain unchanged.
A summary of obligations for this contract, from award date through the date of this action, is given below:

, STATEMENT OF WORK 1
BACKGROUND A meeting of the technical team (Risk Engineering, Inc., et al) with the peer review panel and NRC staff was held on January 19-20,1999. At this meeting the peer review panel had substantive comments on the presentations pertaining to the draft reports for Tasks 1,2,3, and 6.' The peer review panel also recommended additional refinements to the Task 1,2,3, and 6 I
scope'(a' revised per contract Modifications Numbers 1 and 9) pertaining to the spectral shape s
that will be used for design.
The NRC staff agrees with the peer review panel comments and recommendations and has concluded that their advice can be accommodated within the scope characterized by the second j
project objective (providing seismic design response spectra to be used for nuclear power plants considering engineering characteristics and different site and geographical conditions).
2 CONTRACT OBJECTIVES The goal of this procurement is to (1) collect an earthquake strong motion time history database for use in developing response spectra and analyses, (2) develop recommendations for seismic design response spectra to be used for nuclear power plants considering engineering characteristics and different site and geographical conditions, and (3) develop recommendations for minimum power spectral density (or equivalent) requirements for the proposed spectral shapes. These results will be included as technicalinput by the NRC staffin its revision of Regulatory Guide 1.60, " Design Response Spectra for Seismic Design of Nuclear Power Plants."
3 SCOPE OF WORK 3.1 Additional Meeting of the Peer Review Panel 3.1.1 Schedule an additional peer review panel meeting (2 days) in Oakland, CA.
Because of the substentive comments made by the peer review panel members relative to the draft reports for Tasks 1, 2, 3, and 6, the NRC is requesting an additional peer review panel meeting.
3.1.2 The date for transmitting the final project report for Tasks 1, 2, 3, and 6, to the NRC has been extended from August 1,1999, to December 3,1999. A table,
" Proposed Schedule for Final Report Reviews," is attached to make sure that the level-of-effort associated with the report reviews is understood. Intermediate milestone dates can be changed to accommodate additionat writing or review times. The milestone date associated with the submittal of the final report to the NRC (December 3,1999) is fixed.

3.2 Trial Application of the Procedures

3.2.1 Apply the procedures from Tasks 1,2,3, and 6, to two sites; one in the Central l
and Eastern United States,'the other in the Western United States. Gelect sites l
which have adequate data and a good quality seismic probabilistic hazard j
( analysis"so that implementation of the developed procedures can be 1 accomplished with minimal updating of the hazard analysis.

~ Conduct site-specific analyses to implement ali aspects of the p'rocedures isuch as scaling of spectral frequencies, use of M & D data base spectral shape,-
generation of time-histories (as needed), variation of properties, risk-consistent vs. uniform hazard spectra. Develop site-specific " design spectra." During the l
process conduct appropriate benchmarks and comparisons (e.g., comparison with recorded events) to understand issues and rational for decisions which may arise in actual implementation.
3.2.2 Schedule two meetings (2 days each) of the peer review panel in Oakland, CA.
The first meeting should take place after the first site study has been completed and documented in a draft report. The second meeting should take place after both analyses and the draft final report have been completed.
3.2.3 Schedule a 1 day meeting of the technical team with the NRC staff in Rockville, MD, to obtain NRC staff comments on the application of the Task 1,2,3, and 6 procedures to a trial site. It is suggested that this meeting take place after the J
first meeting with the peer review panel. Recommend what peer review panel member (s) should attend this meeting.
3.2.4 ' Based on these two site trials, document insights, key decisions, and assumptions which had to be made. Formalize and provide a step-by-step procedure and detailed guidance for application of the procedures.
3.2.5 The final report (suitable for publication) should be submitted to the NRC on July 2,2000. Drafts of the final report will be submitted to the peer review group and NRC staff for review and comment. Develop a review schedule similar to the attached table, " Proposed Schedule for Final Report Reviews."
3.3 Participate in a Workshop on the Engineering Characterizatio'n of Seismic Input Drs. McGuire and Silva are each requested to prepare a paper and participate in an Organization for Economic Cooperation and Development (OECD) of the Nuclear Energy Agency (NEA) workshop on the engineering characterization of seismic input.
l The purpose of the workshop is to promote an interchange of experience and research information on this topic of high regulatory and safety interest in member countries of OECD.

i 3-Plans for the workshop are still tentative. Based on currently available information the lIl place is Upton, NY: the dates are November 15 - 17,1999 (plan to attend ail 3 days).
Papers are due to the workshop organizers around September 15,1999.

PERIOD OF PERFORMANCE The period of performance will be from the start of the modification through August 31,2000.'
The period from July 2,2000, to August 31,2000, is to allow time to address issues pertaining to the publication of the report on the trial application of the procedures.

5 REPORT REVIEW SCHEDULE AND SPEND:NG PLAN Submit a revised report review schedule and spending plan that incorporates the modifications j
described above. The report review schedule should be similar to the one attached so that the j
level-of-effort associated with each review is clear. Include review milestones associated with the trial application of the procedures. The spending plan should reflect actual costs to date and project costs for the duration of the period of performance of the contract.
f The NRC will commit only the amount of funds that can be fully costed by the contractor by the

end of November 1999. The monthly letter status report for November 1999 (received l
December 1999) should show zero funds remaining, if no new FY 2000 funds were added.
