t Litigation of the nature referenced has been commenced by the Massachusetts Towns of Hudson and Peabody in the
}
i Suffc1k Superior court in Massachusetts.
A motion for a prelim.' nary injunction to stop MMWEC from formally ratifying the MOU was heard in that court during the afternoon of November 15, 1988.
We are advised that the result of that hearing was that the preliminary injunction was denied; an immediate appeal from that denial was taken to the Massachusetts Appeals Court where t't decision of the superior court denying the preliminary injunction was affirmed.
We are further advised that the Board of Directors of MMWEC approved the MOU at a meeting on the evening of November 15, 1988.
