emergency planning and safety contentions presently pending before this Board. In support of this motion, the Town of Hampton states:

1. That by Order dated November 4, 1985, this Board reopened the record to take supplementary evidence on certain On-site Emergency Planning and Safety Contentions presently pending before this Board.

2. In relevant part, that Order provided:

After a pre-hearing conference, after discovery, if any, a supplementary hearing will be ordered to take evidence on the above identified matters pertaining to contentions NECNP I.B.2, NECNP III.1 and NH 20, which involves significant health and saf ety issues, and which were not previously ripe for hearing.

I l 3. By that Order, this Board f urther indicated a willingness to

[ consider reopening the record for presentation of evidence on

! contention NH 10. See Order, Note 2.

) 4. That by motion dated June 17, 1986, Applicant requested this 0 Board to close the evidentiary record on the foregoing contentions and

t hl to issue an operating license for Unit 1 of Seabrook Station for operation not in excess of five percent of rated power.

i 5. That the Town of Hampton objects to Applicant's motion to the l extent it seeks to prevent interested parties and participants to this a

fproceedingfrombeingaffordedapre-hearingconference, discovery,and d

an evidentiary hearing previously provided for by order of this Board.

i 6. That pursuant to 10 CFR S2.715 (c), the Town of Hampton

j! requests this Board to schedule a pre-hearing conf erence, discovery, and an evidentiary hearing on the foregoing contentions, and permit the f Town of Hampton, and other interested parties and participants, to cross-examine and participate therein.

7. That the Town of Hampton f urther requests this Board to reject I

substantial safety risks, as addressed in the pending contentions, particularly in view of the recent Chernobyl accident.
