3 This is an affirmation session, and we have one item 4
before us today.
Before I ask the Secretary to lead us through i

The subject is Review of ALAB-853, In the Matter l
12 of Public Service Company of New Hampshire.
l 13 The commission is being asked to'act on an order i
14 which completes its review of ALAB-853, and the issue of 15 whether a utility must submit either a governmental or utility 1
1' 16 radiological emergency plan for the entire plume exposure 17 pathway emergency planning zone for the facility, before the 18 Commission may issue any operating license, including one t
19 conditioned to permit only fuel loading or operations at less i
20 than 5 percent power.
j 21 Chairman Zech and commissioner Bernthal have approved 22 an order which reverses the Appeal Board decision, and I
23 indicates that, "In the special circumstances of this case, our 24 judgment i.s that sound policy favors requiring the filing of a 25 state, local or utility plan before any operating license is I,

1 issued, including a license confined to fuel loading or low i

power testing."

Commissioner Asselstine has approved the result of i
4 the order, and has additional views.
5 Commissioners Roberts and Carr have disapproved the 1
t j
6 order.
They would have approved an order affirming the Appeal 7
Board decision.
They both hav's dissenting views.

8 The Applicant's recent motion suggesting that the j
9 issue has become moot with the filing of a utility plan is i
10 addressed in Note 1.
That note includes a schedule for

11 parties' responses to the motion.
The Commission will address i
12 the motion at a future date, after considering the parties'
