SUMMARY
DISPOSITION MOTION FOR UTAH K Private Fuel Storage L.L.C. (" Applicant" or "PFS") hereby requests an extension of time in which to file a 20-page briefin support of a partial motion for summary disposition with respect to Utah Contention K. Under the August 20,1998 Atomic Safety and Licensing Board (" Board") Memorandum and Order (Additional General
- Schedule Guidance and Informal Discovery Status Conference Schedule), summary disposition motions 20 pages in length are to be filed 45 days or more before the final
. summary disposition motion filing date. For the Group I contentions, the final date for-the filing of summary disposition motions is June 28,1999, which makes the cutoff date for filing summary disposition motions of 20-page briefs May 14,1999.
Applicant intends to file a partial motion for summary disposition with respect to Utah K to endeavor to narrow the issues for hearing with respect to the various facilities and activities encompassed within the bounds of that Contention. Applicant, with the 9905120027 990506 PDR ADOCK 07200022 C

agreement of counsel for the State, has scheduled depositions of State personnel knowledgeable with respect to those facilities for next week, May 10-12. In order to allow sufficient time to review the transcript of the depositions for potential inclusion in a summary disposition motion, Applicant hereby requests an extension of time to May 18, 1999 for filing a motion for summary disposition of 20 pages in length with respect to Utah K.' Applicant has conferred with counsel for the other lead parties for Utah K, the State and the NRC Staff, and neither opposes this motion.
Wherefore, the Applicant requests that it be allowed to file a motion for summary disposition of 20 pages in length with respect to Utah K through May 18,1999.
