SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING AMENDMENT N0.93.TO FACILITY OPERATING LICENSE NO. NPF-3 TOLEDO EDISON COMPANY AND THE CLEVELAND ELECTRIC ILLUMINATING COMPANY DAVIS-BESSE NUCLEAR POWER STATION, UNIT NO. 1 DOCKET N0. 50-346

1.0 INTRODUCTION AND BACKGROUND

The Nuclear Regulatory Comission (NRC), on August 29, 1983, in Federal Register Vol. 48, No.168, amended its regulations,10 CFR 50.72 and 50.73, to revise immediate reporting requirements and to establish a new reporting system for significant events at nuclear power plants. On December 19, 1983, the NRC issued Generic Letter No. 83-43, Reporting Requirements of 10 CFR 50, Sections 50.72 and 50.73, and Standard Technical Specifications (STSs), informing all licensees of the revision to Section 50.72, Immediate Notification Requirements, and the addition of a new Section 50.73, Licensee Event Report System. The licensees were requested to update their Technical Specifications (TSs) to include the new requirements, and model STSs were provided showing the revisions that should be made in the " Administrative Control" and " Definition" sections. The letter also requested the licensees to review and update other areas of the TSs concerning reportability, as required.

On December 16, 1984, Toledo Edison Company (the licensee) submitted a proposed amendment with revisions to Facility Operating License No.

NPF-3 for the Davis-Besse Nuclear Power Station, Unit No. 1 (the facilitf). The proposed amendment contained changes to the facility TSs in response to Generic Letter 83-43.

2.0 EVALUATION The proposed changes to the TSs submitted by the licensee in response to Generic Letter 83-43 were patterned after the model STSs provided in the letter.

In addition, the licensee had reviewed TS sections other than the Administrative and Definition sections to update other reporting requirements and references to bring them into line with the new regulations.

The immediate reporting requirements of 10 CFR 50.72 are not cited in the TSs since these regulations stand by themselves and inclusion in the TSs would be redundant. The new Licensee Event Report System of 10 CFR 50.73 has been included by providing the definition of the new term 8606260214 860408 DR ADOCK 0500 6

. " Reportable Event;" deleting the obsolete term " Reportable Occurrence;"

referring to the new regulations in Section 6.6, " Reportable Events;"

and by deleting Sections 6.9.1.7, " Reportable Occurrences," 6.9.1.8,

" Prompt Notification with Written Followup" and 6.9.1.9, " Thirty Day Written Reports," and all references to these deleted sections. We have reviewed these changes and find that they conform to the model TSs provided with Generic Letter 83-43 and are therefore acceptable.

In addition to the above specific changes, the Generic Letter requested the licensees to modify other sections of the TSs to conform to the new reporting regulations, yet maintain any special reports required by the present TSs. The licensee submitted proposed changes to the reporting requirements in the fire protection sections. We have reviewed these proposed changes and find them acceptable.

We noted that some of the special reports presently required by the Davis-Besse TSs in the area of fire protection are not consistent with the STSs now being used for near term operating licenses.

It is recommended that the licensee review the reporting requirements for fire protection and propose whatever changes may be necessary to bring the TSs into conformance with current requirements.

In addition, Index Page I and 3/4 pages 6-9 and 6-32 were corrected to conform with the new definitions and section number changes by deleting reference to Section 6.9.1 3.0

SUMMARY

We have reviewed the above changes and find that they are administrative' in nature, consistent with the guidance in Generic Letter 83-43, have no affect on safety, and that with the above changes in the Fire Protection Section, conform with STSs. Therefore, the changes are acceptable.

4.0 ENVIRONMENTAL CONSIDERATION

This amendment relates to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this amendment.

5.0 CONCLUSION

We have concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the. proposed manner, and (2) such activities will be conducted in compliance with the Commission's regulations and the issuance of this amendment will not be inimical to the comon defense and security or to the health and safety of the public.
