ALLEGATION REGARDING LINEAR ACCELERATOR- KANSAS

- On Wednesday April 28,1999, I telephoned Ms. Amanda Frye of Redlands, California in y response to her April 6,1999 letter of concern on the siting of a Linear Accelerator in a residential area in El Dorado, Kansas. Ms. Frye stated that her parents live next door to the proposed clinic. I explained to Ms. Frye that the NRC does not by law regulate these devices, and since they are regulated by the State of Kansas, her letter would be referred to the State. I asked whether she wanted her name withheld from the referral letter to Kansas and she replied, no.

Ms. Frye asked me which Federal agency " supervised" the use of Linear Accelerators in Kansas and if the Kansas regulations on Linear Accelerators are reviewed annually. I replied that I did not know. Ms. Frye stated that she had reviewed a copy of the Kansas radiation control regulations and that she felt they did not specifically address Linear' Accelerators. She further stated that a Zoning Board Meeting was scheduled to rule on this issue and that she was informed that this was "just a formality."

' I informed Ms. Frye that she would be provided with a copy of our referral letter to the State of Kansas.
