Enclosed for your information is a letter from Ms. Amanda Frye dated April 6,1999, regarding the siting of a linear accelerator in El Dorado, Kansas.

As you know the U.S. Nuclear Regulatory Commission (NRC) regulates nuclear facilities and materials in accordance with the Atomic Energy Act (AEA) of 1954, as amended. Linear accelerators produce radiation by electronic means, are not addressed in the AEA and are not subject to regulation by the NRC. I am therefore, referring Ms. Frye's letter to you for appropriate handling.

Dear Sir or Madam:

I r.m alarmed that nuclear regulations in Kansas would allow radiation linear accelerators to be placed in residential neighborhoods.

My parents, Bill and Norma Johnson who live at 812 W. Central in El Dorado, Kansas, where told by representatives of Susan B. Allen Memorial Hospital on March 15,1999, that the hospital was purchasing the residence next to my parents and putting in a radiation unit. The property would have to be rezoned corimercial. I was told by Stan Stewart, city manager of El Dorado, that "the zoning change for this lot would pass" and that "the city did not care what would be put on this property." The request for zoning change fails to mentions the fact that a linear radiation accelerator will be placed on the property. I am  ;

appalled that Kansas citizens can have their homes and lives threatened by radiation units within mere feet of j their doorsteps.  !

I have contacted various employees at the Kansas Department of Health and Environment Bureau of Air and Radiation. Tom Conley, Jan Sides and Ron Fraass have told me that Kansas regulations do not care where these radiation units are located and that the location of radiation units in residential neighbors is l okay. I have read Kansas nuclear regulations and I am shocked at what little protection these verbose documents offer the citizens of Kansas. I am further displeased with the irresponsible and flippant attitude

. that the Kansas officials have about the placement and licensing of radiation units. Furthermore, I was informed that there is no annual review of the nuclear regulatory documents in Kansas.

I am extremely alarmed that the United States Nuclear Regulatory Commission allows States such as Kansas to govern and regulate the nuclear industry w!th such a careless attitude. I believe that such _

recklessness endangers citizens of Kansas and of the United States of America. Please contact me at the above address or phone number to let me know what you can do to help protect innocent citizens of Kansas and of the United States of America.
