Dear Madam Chairman:

This responds to your request of April 22, 1986 for the Commission's comments on the Subcommittee's report concerning the " Nuclear Waste Policy Act of 1982:

Progress and Problems."

We have reviewed the report and wish to comment on the one item which specifically addresses NRC's role in the repository program.

We appreciate the recommendations of the Subcommittee concerning reforming our repository licensing process.

The Commission is committed to making the licensing review as efficient as possible.

The Commission continues to believe that the three-year period provided by the NWPA is a very optimistic estimate for the time required to reach a licensing decision on repository construction.

Of course, our ability to meet the statutory 36-month review period continues to be dependent on the submittal by the Department of Energy of a complete and high-quality application for a repository license.

The NRC staff has been considering and has presented to the Commission several initiatives for streamlining the licensing process, including:

Implementing an information management system (Licensing Support System (LSS)) to facilitate management of the large volume of documents that will be generated in support of the repository license application; Amending the Commission's rules of practice in 10 CFR Part 2 to require parties to the licensing proceeding to use the LSS for satisfaction of initial discovery requests for relevant documents, thereby reducing the need to rely on a typically lengthy discovery process for identification of licensing documents; Establishing a Federally Funded Research and Development Center (FFRDC) to avoid delays caused by any potential conflict of interest issues in our technical research; and Ot06250301 860612 PDR COMMS NRCC CORRESPONDENCE PDR

i The NRC is also undertaking a comprehensive and systematic evaluation of the licensing process to identify and implement other opportunities for efficiencies, and will review any relevant recommendations as part of this effort.

We will inform you of the results of this study.
