Dear Governor Atiyeh:
We are in receipt of your letter dated April 25, 1986, recommending certain procedures for scheduling future Basalt Waste Isolation Project (BWIP) meetings between the Department of Energy (00E) and Nuclear Regulatory Commission (NRC).
The NRC agrees that it is vital to the high level waste (HLW) repository program that affected States and Indian Tribes not only be kept informed of DOE /NRC interactions, but also participate in those interactions.
Since 1982, there have been at least sixteen BWIP site specific technical meetings and/or workshops.
Of this total, five were conducted in the Washington, D. C. area, and the remainder were conducted in Richland, Washington.
To the extent practical, the NRC will continue to conduct as many BWIP related meetings as possible in Richland, Washington.
Regarding your request for periodic briefings on matters discussed at generic meetings conducted in Washington, D.
C.,
the States and Indian Tribes have, and will continue to receive summary meeting minutes of all D0E/NRC meetings.
Additionally, periodic meetings will be held with affected States and Indian Tribes to allow their participation in resolution of generic items and site specific issues as appropriate.
As an example, the NRC held a meeting in April, 1986 with all involved States and Indian Tribes in Las Vegas, Nevada to discuss generic items of interest such as streamlining the licensing process and a demonstration of the licensing support system.
Your contacts will be notified when additional meetings are planned.
The NRC agrees that improvement is needed in the area of timely dissemination of pre-meeting material.
It is for this reason that Waste Management Policy No. 34 was developed.
Please find enclosed for your reference a copy of this policy.
As is stated in the document, NRC will normally provide notification and furnish substantive new pre-meeting documents four weeks prior to the meeting.
In any case, a minimum of ten working days will be given for notice and distribution of materials.
