MINUTES OF THE CRGR MEETING NUMBER 338 The Committee To Review Generic Requirements (CRGR) met on Tuesday, March 23,1999, from 9:00 a.m. to 11:30 a.m. Attachment 1 contains the list of attendees.

S. Newberry and D. Allison, both of NRR, briefed the CRGR on 10 CFR Part 50.72,"Immediate Notification Requirements for Operating Nuclear Power Reactors," and 50.73, " Licensee Event Report System" rulemaking. Attachment 2 contains the staff's presentation material. Noting that this rulemaking effort still needs a lot more work, the Committee made various comments and recommendations. Most importantly, the Committee recommended that (1) the objectives and substance of this rulemaking need to be consletent with other NRC Initiatives to redefine the reactor oversight program outlined in SECY 99-007; (2) distinction between operability v.

functionability, in the context of degraded conditions, needs to be clarified; (4) a tailored list of engineered safety features needs to be included; and (5) more emphasis needs to be placed on the contents of the licensee event reports (LERs), as the emphasis of the rulemaking package, as drafted, appears to be on the threshold for reporting requirements. In addition, the CRGR urged the staff to seek comments on whether these changes are in keeping with the trend to

. rely more on performance indicators to assess plant performance. The Committee accepted the staff's request to defer formal CRGR review until after resolution of public comments, and has no objection to the issuance of this rulemaking for public comments.

T. Collins, J. Wermiel and J. Donoghue, all of NRR, briefed the CRGR on the Rulemaking Plan for amending Appendix K to 10 CFR Part 50, "ECCS Evaluation Models." Attachments 3-A and 3-B contain the staff's presentation material. The Committee made various comments and recommendations. There are no inherent backfits. Using nuclear instrumentation calibration as an example, the staff stated that licensees would be able to make the modifications to install new and more accurate flow measuring instrumentation without prior NRC approval under the provisions of 10 CFR 50.59. The Committee suggested that the staff confirm that there are no technical specification requirements, and their bases, which rely upon 2-percent measurement, which would preclude such a change. The presence of the 2-percent margin in technical specificctions would limit the opportunity for licensees to change the power measurement  ;
