MAINTENANCE RULE BRIEFING PACKAGE The staff has prepared a Commission briefing package (attached) to facilitate discussions during the May 5,1999, Commission meeting on the status of the revision to the maintenance rule,10 CFR 50.65. The briefing package contains the rulemaking package that was forwarded to CRGR by memorandum dated April 9,1999, the current version of the DRAFT regulatory guidance that supports the (a)(4) revision in the CRGR presentation version of the rule, and the CRGR's comments and recommendations on the rulemaking package.

Also included is a work-in-progress version of paragraph (a)(4) that includes language limiting the scope of SSCs for the pre-maintenance assessments. The work-in-progress (a)(4) paragraph was developed after consideration of feedback from Commissioners and stakeholders on assessment scope rule language. The limited scope would allow licensees and NRC inspectors to focus on proposed maintenance activities for those SSCs that can be shown to have an impact on plant risk. At this time, the draft regulatory guide contains methods for limiting the scope of pre-maintenance assessments.

To ensure the intent of this limited scope provision is clearly understood and properly implemented, the staff would have to revise the statements of consideration and the regulatory guidance should the Commission decide to pursue this option.

The staff recommends that the information provided be made available to the public prior to the May 5,1999 Commission briefing.
