SUBJECT:

CONTROL OF NRC RULEMAKING By memorandum of February 13, 1984, " Control of NRC Rulemaking by Offices Reporting to the EDO," Offices were directed that effective April 1,1984, (1) all offices under ED0 purview must obtain my soproval to begin and/or continue a specific rulemaking, (2) resources were not to be expended on rule-makings that have not been approved, and (3) RES would independently review rulemaking proposals forwarded for my approval and make recomendations to me concerning whether or not and how to proceed with the rulemakings.

In accordance with my directive, the following proposal concerning rulemaking has been forwarc'ed for my approval.

Proposed rule, " Shallow Land Disposal of Low-Level Radioactive Waste."

(Sponsored by NMSS - memorandum, Minogue to ED0 dated May 14,1985.)

I approve termination of this rulemaking. The NRC Regulatory Agenda (NUREG_0936) should be modified to reflect the status of this rulemaking.

SUBJECT:

CONTROL OF NRC RULEMAKING. TERMINATION OF RES INDEPENDENT REVIEW 0F RULEMAKING SPONSORED BY NMSS On March 14, 1985, the Director of the Office of Nuclear Material Safety and Safeguards recommended that NRC terminate the NMSS-sponsored rulemaking,

" Shallow Land Disposal of Low-Level Radioactive Waste," which is the NRC response to petition for rulemaking PRM-20-7, and transmitted the rulemaking to RES for independent review.

During the time of, the RES independent review, you signed a Federal Register notice of denial of PRM-20-7 on March 29, 1985.

In view of your signature on that notice, RES considers that continuation of the independent review of the specific ongoing rulemaking is not necessary.

Accordingly, RES is terminating the independent review and will make no independent recommendation concerning whether to' proceed with the rulemaking,

" Shallow Land Disposal of Low-Level Radioactive Waste."

TRIP OF BOTH MAIN FEEDWATER PUMPS j

At:5:03 a.m. (CDT), June ?, '1985,'while operating at 85 per cent power, the unit auto-

matically tripped because of a high turbine; vibration.; The vibration. occurred during ta test of :the main' turbinc control valve.

!Following the reactor tr,ip, both main feedwater pumps-tripped urexpectedly.' The j

auxiliary Feedwater System started as designed and maintained feedwater level. in the

steam generators. Also, during the unit trip, one mair1 steam safety valve operated

+ for approximately two minutes to relieve steam pressure.' Preliminary review of;the blowdown. indicates:that-the safety valve operated as designed. The unit remains in hot standby while the licensee : investigates the cause of the trip of,the main foedwater pumps. The unit is expected to remain shutdownifor more than two. days.

.The Resident Inspector and Region IIII -(Chicago) are ;following the licensee's. course of action.

.The State of Ohio Will be notified.
