This responds to your October 28, 1907 letter to re regarding the assur;tions preser.ted in the October 21, 1987 metrorardum from Frank Congel, MC, to Richard Krim, F EFA , for the FEPA review cf of fsite plars submittec' by a utility. You propose tnat assumption Number 3 be reworded. We agree; there-fere, the three assumptiers are:

In developing evaluation criteria and in reviewing utility spensored of f site en+rge9cy response plans, FEMA should assume that in an actual energency, state and local officials will (1) esercise their best efferts to protect the health and safety of the public.

(2) cooperate with the utility and follow the utility offsite plan, and (3) have resources sufficient to irplement those portions of the utility of fsite plan where state or local response is necessary.

We also accept the procedure outlined in your letter foi noticing the avail-abilicy of the utility plan evaluation criteria for public cornment in the Federal Register, while using the criteria os an interim basis, as NRC preposed at the October 15, 1987 meeting.

Because of the strong consensus amofig the FEKA/NRC Task Force merbers as evider.ced by their ear'y delivery of the draft criteria, I do not believe that it will be necessary for us to meet or. November 13, 1987, as we had planned.

It is expected that the NRC will deterd the asstaptions in hearirgs and in other legal and public forms.

Let me reiterate that what we agree to at this/me ti is tentative. As we proceed jointly with 20 in the pmject concernirs criteria for the evaluation of a utility plan, there may be a need to add or delete asstrptions or make other charges. However, asstr.ptions 1, 2 ard rewrded 3 arculd provide a workind framework for the criteria effort. -

During our meeting on October 15, 1987, you and I also discussed sending

' out the criteria for public coment prior to using it for the evaluation of aa of fsite radiological emergency response plan subsitted by a utility. As an alternative, you proposed a procedure whereby af ter concurrence by FEMA and NRC, the utility plan criteria would be used on an interim basis to revieu the utility plan for the Massachusetts part of the Seabrook Emergency Planning Zone, according to the provisions of the FEMA /NRC Memorandum of Understanding. At the same time, a notice would be published in the Federal Register that the criteria are available for coment. Copies would also be sent to States and other parties for coment. A similar process was used in 1980 for the publication of NUREG-0654/ FEMA-rep 1, Rev. 1. Based on this Drecedent, we accept this procedure, with the understanding that any appropriate thanges in the criteria will be made promptly after review of the public
