Dear Mr. Chairman:

t I am responding to your letter dated September 27, 1980, in which you requested that the U.S. Nuclear Regulatory Commission (NRC) review and comment on a report you had received from the Honorable Remo Mancini, a member of the Ontario Provincial Parliament.

The i

l NRC staff has reviewed the report and has concluded that there are

~

staff or are not being adequately addressed by the licensee's no new safety concerns which were not previously known to the i

improvement program.

Detroit Edison has committed to NRC tu implement programs to correct operational deficiencies, and NRC is closely following the licensee's progress in meeting these commitments.

Recent monitoring has shown inproved operational performance.

A recent NRC Systematic Assessment of Licensee Performance (SALP) i determined that Fermi-2 was being operated safely.

However, because of past weak performance in a number of key areas, the NRC has designated Fermi-2 as a plant that warrants increased NRC attention.

NRC actions have included reducing the period of time between SALP reviews (from 12 months to 9 months); assigning another part-time resident inspector to assist the two currently l

assigned to Fermi-2; and conducting a number of planned inspection l

activities in problem areas, including a special diagnostic evaluation team inspection (OETI) to gain a better understanding of the reasons for the facility's weak perfornance.

The DETI l

results will soon be made publicly available.

Because we have been aware of Canadian concernt for some time and have met with Canadian officials on a number of occasions to discuss Fermi-2, i

the NRC has offered to brief Canadian officials on the results of 4

the inspection.

In addition, on July 25, 1988, senior NRC l

managers met with the Chairraan of the Board of Detroit Edison i

Company and board members Nith nuclear oversight responsibility to

reiterate to Detroit Edison Company the need for improvements in plant performance.

. By letter dated September 22, 1988, the Deputy Assistant Secretary of State for Nuclear Energy and Energy Technology Affairs, Mr. Richard Stratford, in responding to Mr. Mancini's letter concerning the same report, indicated that the United States will continue to regulate operation of Fermi-2 to ensure that the health and safety of the public are adequately protected.
