REQUEST FOR VACATION OF STAY Now come the Applicants and say as follows:
1.
On November 20, 1986, the Appeal Board decided ALAB-853, in which it held that-the regulations and prior Commission' precedent did not require the existence of any off-site emergency plans prior to the issuance of a license
=for fuel loading or precriticality testing.

On January 9, 1987, this Commission issued an' order u
stating its decision to review ALAB-853 sua.sponte to I
consider a single issue:
"whether as a matter of law or policy a utility applicant should be required to submit a radiological emergency plan (either a governmental' plan or a 1

-utility plan) forLthe entire emergency planning zone (EPZ) for the facility before any operating-license may be issued."
This Commission also stayed the Director of Nuclear Reactor Regulation (NRR)'from authorizing low power operations at the Seabrook facility until the Commission's review is complete.

The issue as to which review has been taken has vitality for Seabrook Station because there presently exists for that portion of the Seabrook Station EPZ which lies within the Commonwealth of Massachusetts no emergency plan due to the fact that (1) the Governor of the Commonwealth has refused to forward such a plan for review and (2) the utility has not filed such a plan.

Under date of April 8, 1987, the Applicants are j
filing in the Seabrook Dockets a utility plan for that portion of the Seabrook EPZ which is located in the Commonwealth of Massachusetts entitled "Seabrook Station -
Radiological Emergency Preparedness Plan for the Commonweal,th of Massachusetts."
WHEREFORE the Applicants suggest that the issue pending before the Commission is moot and respectfully pray the Commission:

To dismiss the review proceeding before it as moot.
