Dear Mr. Garica:
This is in response to your request of October 23, 1988, for the Conraf ssion to extend the public coment period on the ;:roposed fitness-for. duty rule and to hold public hearings on the west coast. As further discussed below, the Comission has provided ample opportunity for public awareness of and participation in this rulemaking process. Accordingly, your request must t'e denied.
Coments on the proposed rule should be submitted by November 21, 1988.
Nevertheless, coments received af ter that date will also be considered if it is practical to do so.
However, we cannot assure full consideration except as to comments received by November 21, 1988.
The Comission indicated it was considering this rulemaking and discussed the general contents of the proposed rule during a public meeting on December 1, 1987. The contents of the proposed rule (SECY 88-129) were discussed in detail during a public meeting on June 21, 1988. The Comission held still another public meeting in Rockville, Maryland on October 17, 1988, to further public understanding of the issues and to facilitate the public coment process. A national representative of your union was present. A transcript of that meeting was provided under separate cover.
No additional public meetings are planned at this time.
We appreciate your interest in this rulemaking and will give your written coments careful conside ation when they are received. We will inform you if there is any change in comment period or additional public meetings regarding this rulemaking.
