SECY-87 Stock Ownership by NRC Employees The Commission * (with Chairman'Zech and Commissioners Roberts, Bernthal, and Carr agreeing) approved amendments to 10 CFR Part 0 which (1) narrowe the scope of the regulation so that only the major companies engaged in nuclear. fuel cycle activities are placed on the agency's prohibited stock list and (2) provide explicitly that no employee is to provide advice to the NRC on matters affecting a company on which he or she has a vested pension interest unless an exemption has been granted the employee.

Commissioner Asselstine has approved the change related to vested pensions but disapproved narrowing the scope of the regulations as presently applied to fuel cycle activities.

(Subsequently, on April 2, 1987, the Assistant Secretary signed the Federal Register Notice.)

  • Section 201 of the Energy Reorganization Act, 42 U.S.C.
S5841, provides that action of the Commission shall be determined by a

" majority vote of the members present."

Commissioners Roberts and Carr were not present when this item was affirmed.

Accord-ingly, the formal votes of the Commission were 3-0 and 2-1 in favor of the-decision.

Commissioners Roberts and Carr, however, had previously indicated that they would approve this paper and had they been present they would have affirmed their prior votes.
