Dear Mr. Airozo:
This is in response to your letter dated February 6, 1987, in which you appealed Mr. Donnie H. Grimsley's response form dated February 2,1987, which denied eight documents subject to your Freedom of Information Act (F0IA) request for documents related to inspector training and 0IA activities.
1 Acting on your appeal, I have carefully reviewed the record in this case and have detennined that the previously withheld documents will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C 552(b)(5)) and 10 CFR 9.5(a)(5) of the Consission's regulations. Your appeal is, therefore, denied.
The documents are internal memoranda which contain the advice, opinions, and reconnendation of the staff. As such, they are considered
.predecisional; and their release would prejudice the open and honest analysis and opinions of evaluators necessary to successfully formulate a reasonable government negotiation position.
l This is a final agency decision. As set forth in the F0IA (5 U.S.C.
552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside, have your principal place of business, or in the District of Columbia.
