'T APPENDIX A NOTICE OF VIOLATION Omaha Public Power DWict Docket: 50-285 Fort Calhoun Station Operating License: DPR-40 During an NRC inspection conducted on September 1-30, 1988, violations of NRC requirements were identified. The violations involved failure to submit a report for a nonfunctional fire barrier, failure to check nonfunctional fire doors hourly, and failure to provide instructions for removal of a snubber from a nonsafety-related system. In accordance with the "General Statement of Polic and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988 . the violatione are listed below.

A. Failure to Submit a Special Report on Inoperable Fire Barrier _

Technical Specification 2.19(7) states, in part, that all penetration fire barriers protecting safety-related areas shall be functional (intact). If nonfunctional, restore the penetration to a functional status within 7 days, or prepare and submit a repori; to the Comission within an additional 30 days.

Contrary to the above, Fire Door 1007-16 was not repaired within 7 days and a report was not submitted to the Comission within the next 30 days.

This is a repeat violation.

This is a Severity Level IV violation. (Supplement I)(285/8832-01)

8. Failure to Provide Fire Watch Patrol Technical Specification 2.19(7) states, in part, that all penetration fire barriers protecting safety-related areas shall be functional (intact).

With a penetration barrier nonfunctional, verify the operability of fire detectors on at least one side of the penetration and establish an hourly fire watch patrol.

Contrary to the above, the licen:ee's fire watch patrol was not provided during the hours of 10 a.m. to 12 p.m. on September 29, 1988, for all nonfunctional fire barriers. This is a repeat violation.

C. Removal of Seismic Support without Written I,structions Technical Specification 5.8.1 requires written procedures and administrative policies be established, implerented, and maintained that meet or exceed the minimum rec"airements of Secticn 5.1 of ANSI 18.7-1972.

Paragraph 5.1.6 of ANSI 18.7-1972 states, in part3 that maintenance or modifications that may affect functioning of safety-related structures, systems, or corponents shall be performed in a manner to assure quality at hYN 0

least equivaient to that specificd in I,pplicable codes, bases, standards, and design requirements. It further states that maintenance that can affect the performance of safety-related equipment shall be properly preplanned and perforned in accordance with written procedures, documented instructions, or drawings appropriate to the circumstances.

Contrary to the above, the licensea removed Seismic Support AXS-10 without regard to original design requirements and performed this modification without the use 6f written inst"vetions.

Fursuant to the provisions of 10 CFR Part 2.201, Omaha Public Power District is hereby required to submit to this office, within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation: (1) the reason for the violation if admitttJ, (2) the corrective corrective steps steps that willthat behave takenbeen takenfurther to avoid and the results 'chieved,)(3) violatic , and (4 the the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
