you yesterday, Mr. Bisbee, is the New England Coalition on 2

Nuclear Pollution motion for leave to file a second set of 3

interrogatories and requests for production of documents to 4

the state of New Hampshire on revision 2 to the New Hampsh' ire 5

radiological emergency response plan.

Ms. Curran filed in a 6

responding pleading, which is the interrogatories themselves, 7

on April 2, yesterday.

8 Since this is going to a second round of 9

interrogatories, and I have just completed --

11 JUDGE H0YT:

We had a brief pause here.

Picking 12 up the thread of what I was trying to convey to you and O)

13 Mr. Bisbee, Ms. Curran, is this second round of 14 interrogatories seem to me that we could perhaps use a 15 conference call to get some sort of indication of whether or 16 not we could handle these responses a little bit easier than 17 making a formal process of it, Mr. Bisbee coming down 10 days 18 later with his responses and then we have to sit down and 19 write up our ruling on it.

20 If that process would be helpful, and it would 21 seem to me that it would be, because you have an indication 22 of the -- how the board is going to rule on one of these 23 things, almost instantaneous, rather than waiting for a much 24 longer period of time and you would have the information you l

25 need which would give you a longer time for preparation.

1 would seem to me that that would be a more productive process 2

for the Intervenors, particularly Ms. Curran, to prepare with 3

at this additional time.

Does that make any sense to you at 4

all?

5 MS. CURRAN:

I am not sure I understand what you 6

are saying.

You are saying you would be willing to rule 7

orally on the motion for leave to supplement our 8

interrogatories?

9 JUDGE H0YT:

I would like to see if we can do 10 that, yes.

I think this is as much an exploratory 11 conversation as anything today.

Would you have any problem 12 with that?

You would get more -- you would get an indication

13 of whether or not you were going to get a response which 14 would give you a longer time to prepare your case.

15 MS. CURRAN:

Yes.

It seems like on fairness; 16 otherwise it would be more on Mr. Bisbee, because he wouldn't 17 have a chance to respond.

18 JUDGE H0YT:

I think that's very true.

I think 19 that's one of the reasons we have to look at this as merely 20 an exploratory conversation here, at least in the beginning 21 of the session.

22 MS. CURRAN:

23 JUDGE H0YT Let us bring Mr. Bisbee into the 24 conversation now and ask him if after you got these 25 interrogatories yesterday.

i problem in, perhaps in some cases being able to answer these 2

and in other cases indicate that you didn't have an answer or 3

would never have the answer, or you would never respond to a 4

particular one of the interrogatories that Ms. Curran has in 5

her second set?

6 MR. BISBEE:

If I might respond to the two general 7

inquiries you made, Judge Hoyt, the first one being the 8

process generally of working out the resolution of a 9

particular motion filed in this action and the second one 10 being the second one filed yesterday, I do not have any 11 objection to this process, this motion to resolve what 12 otherwise would be a more involved process on what is a 13 limited motion for an additional 12 or 13 interrogatories.

14 As to those specific questions individually, I have asked 15 both our civil defense people and those at the Department of 16 Public Health Services to review that.

I have heard back 17 that we will be in a position to be able to respond to them 18 fairly expeditiously.

I don't know what time frame you are 19 looking at.

20 JUDGE HOYT:

Let's see, you had, Ms. Curran, I 21 believe, eight -- no, more than that, 16 different 22 interrogatories.

Mr. Bisbee, does Ms. Curran's 16 23 interrogatories pose no problem at all?
