On March 10; 1999, the Nuclear Regulatory Commission (NRC) staff met with the Nuclear Energy institute (NEI) and the industry Robust Fuel Program (RFP) at the NRC offices in

)

Rockville, MD. Meeting attendees are listed in Attachment 1. The purpose of the meeting was

. to discuss a process for use in establishing and supporting licensing criteria to be applied for fuel burnup extensions beyond 62 GWd/MTU Other topics discussed were some NRC Research activities associated with major accidents and possible industry interest in pursuing a rulemaking change to reduce the need for regulatory exemptions for fuel cladding materials that fall outside of the scope of materials currently cited in the regulations.

Industry Interest in Rule change affecting fuel cladding materials This item was discussed first to accommodate schedule limitations of meeting participants.

Current regulations accommodate cladding materials that meet the material specifications for Zircaloy or ZlRLO. Use of cladding materials that fall outside of the accepted material specifications for these materials requires an exemption from applicable regulations, irrespective of performance.

The NRC stan requested the industry to consider submitting a petition for rule change that would minimize the need for future exemptions and to consider the form that this petition would take. Possible rule change options were briefly discussed; ranging from a simple change to expand the current list of acceptable cladding materials to changes that would identify required cladding performance characteristics. The NRC stated that because there are no safety issues being addressed by the proposed changes to regulations, the NRC would like to see the industry take the lead in proposing how the regulations should change. In response to a i

question, the NRC stated that requests for cladding exemptions would continue to be addressed, without prejudice, during the process to consider and adopt a rule change. NEl will get back to the staff identifying any industry plans in this area.

I Process for Establishment of Licensing Criteria for Fuel Burnup Extensions Terry Rieck, Chairman, RFP Working Group 2, began the discussion by outlining the problem statements that the RFP is using to guide the development of a process for establishing licensing criteria. He noted that the RFP had established a preliminary framework for a process and that NRC feedback on this framework was needed to provide assurance that the results of the process would meet NRC expectations. John Butler of NEl and Robert Montgomery of ANATECH led a discussion of the RFP process framework. Presentation materials used during this discussion are provided as Attachment 2. The preliminary process is divided into four stages. Activities associated with the first stage establish a baseline for current fuel systems designs. Th:s baseline would identify applicable regulatory requirements, associated fuel limits, key parameters, acceptable methods, processes, measures and data. Subsequent process stages would utilize this baseline to evaluate the impact of fuel burnup and other burnup related effects.

The second stage of the process involves a screening evaluation that is intended to identify i

(screen out) fuel limits that are unaffected by fuel burnup. Items that are affected by fuel burnup (or the effect is unknown) are evaluated further in Stage 3. Stage 3 involves steps that allow a more comprehensive evaluation of fuel burnup effects. The final stage of the process focuses upon the establishment and identification of necessary support for a revised baseline (e.g., fuel

limits, key parameters, acceptable methods, processes, measures and data) for fuel burnup extensions.

During discussion of the process, NRC staff pointed out that the licensing criteria would need to be applied to both fuel burnup extensions and to " advanced fuel designs", A clear definition of what would constitute an " advanced fuel design" was not identified, but the staff noted that small changes to existing fuel designs or cladding materials would continue to be evaluated using current licensing criteria.

The staff also indicated that the process steps discussed as part of Stages 2 and 3 of the process will need to encompass all time-based effects or aging factors (in addition to fuel burnup). These factors include power history and potential water chemistry effects. To assist the development and expansion of the proposed process, it was suggested that the RFP test the process on two or more fuellimits. NRR expressed encouragement about the overall approach and noted that the industry should provide the justification required for disposition of the burnup issues.

Another meeting which will focus on the application of the proposed process will be held in the near future. NEl will pick an area and both NEl and the NRC staff will work through the example in preparation for the meeting.

NRC Research Activities Ralph Meyer summarized NRC plans to develop a Phenomena Identification and Ranking Table (PIRT) that would investigate high burnup fuel effects and their impact on major j

accidents. Dr. Meyer invited industry participation on the PIRT panel and requested that recommendations be forwarded to him, in response to questions, Dr. Meyer stated that the specific objectives of the PlRT panel are being developed and would be made available upon completion. The RFP accepted an action to consider industry participation on the PIRT panel and to provide recommendations for participants.
