Dear Ms. Allen:

I am responding to your request conceming the application process for obtaining a license pursuant to Section 32.14,10 CFR Part 32, authorizing the distribution of products such as watches containing tritium.

In order to possess and use byproduct material, you must first satisfy the general requirements of 10 CFR 30.33. Therefore, you must apply for and obtain a specific license authorizing possession and use of byproduct material from the U.S. Nuclear Regulatory Commission (NRC) regional office or applicable agreement state. If the NRC has jurisdiction, the enclosed NRC Form 313, " Application for Material License," should be completed, in duplicate, and mailed to the applicable regional address as shown on the form.

As an applicant wishing to distribute or initially transfer products containing byproduct material, l such as watches containing tritium, to persons exempt from licensing, you must also apply for and obtain an exempt distribution license from the NRC Headquarters office. NRC Form 313 (P should be completed, in duplicate, and mailed to the Headquarters address as shown on the form.

Your application for a distiibution license should not contain information conceming the possession and use of radioactive material as covered in your possession license. Therefore, when applying for a distribution license, you should answer only questions 1 through 6, and 12 and 13 on NRC Form 313. The product information to be submitted for your distribution license is outlined in 10 CFR Part 32, specifically in Sections 32.14,32.15, and 32.16, and in NUREG-1556, Vol. 8.

Payment of fees should be mailed along with the application package (s) to the U.S. Nuclear Regulatory Commission, Office of Nuclear Material Safety and Safeguards, Division of InduCrial and Medical Nuclear Safety, Wasnington, DC 20555.. Any questions conceming fees should be direct d to Ms. Sandra Kimberley of the License Fee and Accounts Receivable Branch at (301) 415-6096. Please no;e that this fee would only be for an NRC exempt distribution license.
