Dear Mr. Summa:

P This is'in response to your letter, postmarked March 6,1987, addressed to Mr. Victor Stello, in which you expressed your views opposing the licensing of the Shoreham Nuclear Power Station.

One of your reasons for opposing the licensing of Shoreham is your opinion that the Long Island Lighting Company's (LILCO's) Emergency Plan (EP) for Shoreham .;

would not provide adequate protection to the public in the event of an accident.

Numerous contentions on the adequacy of LILCO's EP are currently being litigated before the Atomic Safety and Licensing Boards. The Commission's decision on ,

the-full-power license for Shoreham will be based on the findings of these-adjudicative bodies. While the outcome of these proceedings cannot be predicted, it is certain that no full-power license for Shoreham will be issued unless the Commission finds that there is reasonable assurance that adequate protective measures can and will be taken in the event u? a radiological ,

emergency in accordance with the regulation in 10 CFR Section 50.47. '

You also expressed your concern about "new rules" which may affect the licensing of Shoreham. I believe that you are referring to the Commission's Proposed Rule on Licensing of Nuclear Power Plants Where State and/or local Governments ,

Decline to Cooperate in Offsite Emeroency Planning published in the_ Federal l Register on March 6, 1987 (52 FR 6980). Comnents on the proposed rule should be sent to: Secretary, U.S. Nuclear Regulatory Commission, Washington, D.C. ,

20555, ATTN: Docketing and Services Branch. The connent period expires 60 days l from the date of _ issuance of the proposed rule-in the Federal Reoister or on 1 May 5, 1987. Insofar as the impact on Shoreham licensing is concerned, in the l event that the Commission adopts the proposed rule, I would'like to point out that "...the Commission emphasizes that it would not be possible under this option to license a plant for full power operation unless the applicant demonstrates that adequate offsite emergency planning is achievable and all other aspects of foregoing criteria are satisfied.... The rule change would have a minimal impact on safety" (SECY-87-35). In fact, the compensatory provisions of the proposed rule are consistent with the existing decision of the Connission which states that "LILCO's plan should be measured against a-standard that requires protective measures that are generally comparable to what might be accomplished with governmental cooperation" (CLI-86-13).

Therefore, in terms of the standards against which the Commission would measure the adequacy of the Shoreham EP, there is no significant impact that can be directly attributable to the proposed rule.
