APPLICANTS' RESPONSE TO APPEAL BOARD ORDER OF OCTOBER 25, 1988 On October 25, 1988, this Appeal Board issued an order directing the parties to give their positions on the question of "whether an appeal from the Licensing Board's October 12, l
1988 memorandum and order will lie at this time or, instead, l
I must abide the event of further developments."
The appeal at issue is one noticed by the Attorney General of The Commonwealth of Massachusetts (Mass. AG).
Applicants herein reply as follows:
The referenced order vsu an order excluding late-filed contentions with respect to the prompt notification system for Seabrook Station.
There is still another contention j

i brought by Mass. AG in litigation before the same licensing board dealing with this same prompt notification system.
In short, the order at hand did not (a) dispose of a significant portion of the proceeding or (b) result in the dismissal of Mass. AG from this portion of the proceeding.
Therefore, no appeal lies.
