VOGTLE ELECTRIC GENERATING PLANT REQUEST TO REVISE TECHNICAL SPECIFICATIONS LIMITING CONDITION FOR OPERATION (LCO) APPLICABILITY LCO 3.0.4 in accordance with the requirements of 10 CFR 50.90, Southern Nuclear Operating Company (SNC) proposes to revise the Vogtle Electric Generating Plant (VEGP) Unit I and Unit 2 Technical Specifications (TS) Limiting Condition for Operation (LCO) Applicability LCO 3.0.4 and Surveillance Requirement (SR) Applicability SR 3.0.4 The proposed changes would update the versions of LCO 3.0.4 and SR 3.0.4 that appear in the existing VEGP TS to be consistent with the versions of LCO 3.0.4 and SR 3.0.4 as they appear in Revision 1 to NUREG-1431.
The existing VEGP version of LCO 3.0.4, which was based on Revision 0 to NUREG-1431, states, in part,"This specification shall not prevent changes in MODES or other specified conditions in the Applicability that are required to comply with ACTIONS." The proposed change would add the words "or that are part of a shutdown of the unit," so that LCO 3.0.4 would not prevent shutdowns that are not necessarily required by TS Required Actions. In j

The proposed changes to LCO 3.0.4 and SR 3.0.4 provide additional Mode change flexibility that is not allowed by the existing VEGP TS._ In some cases, this additional flexibility has been determined to be inappropriate (See Enclosure 1). In those cases, Notes restricting this j
flexibility have been proposed for specific affected LCOs. These LCOs are as follows:
LCO 3.1.1; LCO 3.3.1, Condition C; LCO 3.3.8, Condition A; LCO 3.4.8; LCO 3.4.12; LCO 3.9.1; and LCO 3.9.6 l
The proposed changes will eliminate a potential conflict that exists in the Revision 0, i
NUREG 1431 version of the LCO 3.0.4 Bases. These Bases state that the provisions of LCO 3.0.4 shall not prevent changes in MODES or other specified conditions in the Applicability that result from a normal shutdown. Ilowever, this language does not appear in the TS. This represents a potential conflict between the TS and the Bases.
Since the proposed changes eliminate a potential conflict between the TS and the Bases, and they are consistent with Revision I to NUREG-1431, SNC requests approval of the proposed changes by September 1,1999, to support their use during the Fall 1999 refueling outage.
The basis for the proposed changes is provided in Enclosure 1. The Revision 1, NUREG-1431 version of LCO 3.0.4 is only applicable for entry into a Mode or other specified condition in the Applicability in Modes 1,2,3, and 4. The Mode restrictions in the Revision
- 0. NUREG-1431 version of LCO 3.0.4 were previously applicable in all Modes. As a result, the Revision I, NUREG-1431 version of LCO 3.0.4 includes a Reviewer's Note that requires an evaluation of the existing TS to determine where specific restricticns on Mode changes or Required Actions should be included in individual LCOs tojustify this change. This evaluation has been performed and is summarized in a matrix that is included in Enclosure 1.
Pursuant to 10 CFR 50.92, an evaluation that demonstrates that the proposed changes do not involve a significant hazard consideration is provided in Enclosure 2. The proposed changes are marked on the affected TS and Bases pages and are provided in Enclosure 3. In addition, clean typed TS and Bases pages are provided in Enclosure 4.

Faclosure i Vogtle Electric Generating Plant Request to Revise Technical Specifications Limiting Condition for Operation (LCO) Applicability LCO 3.0.4 Basis for Proposed Changes Proposed Changes The proposed changes would update the versions of LCO 3.0.4 and SR 3.0.4 that appear in the existing Vogtle Electric Generating Plant (VEGP) Technical Specifications (TS) to be consistent with the versions of LCO 3.0.4 and SR 3.0.4 as they appear in Revision I to NUREG-1431, Westinghouse Improved Standard Technical Specifications (ISTS). The existing VEGP version of LCO 3.0.4, w hich was based on Revision 0 to NUREG-1431, states, in part,"This specification shall not prevent changes in MODES or other speciGed conditions in the Applicability that are required to comply with ACTIONS." Similarly, SR 3.0.4 states, in part,"This provision shall not prevent entry into MODES or other speciGed conditions in the Applicability that are required to comply with ACTIONS." The proposed changes would add the words "or that are part of a shutdown of the unit," so that LCO 3.0.4 and SR 3.0.4 would not prevent shutdowns that are not necessarily required by TS Required Actions. In addition, the proposed change would also add the following to LCO 3.0.4:
"LCO 3.0.4 is only applicable for entry into a MODE or other speciGed condition in the Applicability in MODES 1,2,3, and 4."
Similarly, the following would be added to SR 3.0.4:
"SR 3.0.4 is only applicable for entry into a MODE or other specified condition in the Applicability in MODES 1,2,3, and 4."
The Mode restrictions of the existing VEGP versions of LCO 3.0.4 and SR 3.0.4 are applicable in all Modes. This change has the effect of removing those Mode restrictions from Modes 5 and 6.
Appropriate Bases language that corresponds to the proposed changes (also taken from Revision I to NUREO-1431) is included.
The proposed changes to LCO 3.0.4 and SR 3.0.4 provide additional Mode change flexibility that is not allowed by the existing VEGP TS. This Hexibility was evaluated using the methodology described in the following paragraphs, and in some cases this additional Dexibility has been determined to be inappropriate In those cases, Notes restricting this flexibility have been proposed for specific affected LCOs. Hasis for Proposed Changes i
11 asis The Westinghouse ISTS in NUREG-1431, Revision 1, contains a Limiting Condition for Operation (LCO) 3.0.4 and Surveillance Requirement (SR) 3.0.4 that have been revised to eliminate ambiguity with respect to transitioning between MODES ofoperation or other speciGed conditions in the Applicability of the TS. Use of the new LCO 3.0.4 and SR 3.0.4 will also result in removing some restrictions on Mode changes that are imposed by the LCO 3.0.4 and SR 3.0.4 contained in the existing VEGP TS. Because removal of Mode change restrictions is a relaxation of the existing VEGP TS requirements, these changes have been evalaated to determine if restrictions should be placed on specific transitions. The need for this review is summarized in a Reviewer's Note appended to LCO 3.0.4 in the ISTS:
" Reviewer's Note: LCO 3.0.4 has been revised so that changes in MODES or other specified conditions in the Applicability that are part of a shutdown of the unit shall not be prevented. In addition, LCO 3.0.4 has been revised so that it is only applicable for entry into a MODE or other specified conditions in the Applicability in MODES 1,2,3, and 4. The MODE change restrictions in LCO 3.0.4 were previously applicable in all MODES. Before this version of LCO 3.0.4 can be implemented on a plant-specific basis, the licensee must review the existing technical specifications to determine where specific restrictions on MODE changes or Required Actions should be included in individual LCOs tojustify this change; such an evaluation should be summarized in a matrix of all existing LCOs to facilitate NRC stafTreview of a conversion to the STS."
The Bases for LCO 3.0.4 in the ISTS provide further information:
"The provisions of LCO 3.0.4 shall not prevent changes in MODES or other specified conditions in the Applicability that are required to comply with ACTIONS. In addition, the provisions of LCO 3.0.4 shall not prevent changes in MODES or other specified conditions in the Applicability that result from any unit shutdown..."
"LCO 3.0.4 is only applicable when entering MODE 4 from MODE 5 MODE 3 from MODE 4, MODE 2 from MODE 3, or MODE I from MODE 2. Furthermore, LCO 3.0.4 is applicable when entering any other specified condition in the Applicability only while operating in MODES 1,2,3 or 4..."
A similar Reviewer's Note is applied to SR 3.0.4 in the ISTS.
The approach used to develop the matrix was to examine the various transitions in Mode or other specified conditions of Applicability (MOSCA) that could result in increased Mode change flexibility under the new LCO 3.0.4 and SR 3.0.4. LCO 3.0.4 and SR 3.0.4 in the existing VEGP TS apply to all changes in MOSCA; whereas, the new LCO 3.0.4 and SR 3.0.4 is applicable only to "startup" activities, i.e., increases in Mode, in Modes 1,2,3, and 4. Therefore, the review identified those existing VEGP TS where the new LCO 3.0.4 and SR 3.0.4 would result in an increase in Mode change flexibility when El-2

Transitions that represent an increased allowance in flexibility have been evaluated to determine if a Note should be incorporated into the VEGP TS to prevent the transition.
The methodology involved a review of all LCOs in the existing VEGP TS to determine which MOSCA transitions would represent a new allowance in flexibility under the new LCO 3.0.4 and SR 3.0.4. (Note that for the purpose of this review, failure to meet an SR was considered to be the equivalent of not meeting the associated LCO. Therefore, the LCO 3.0.4 review applies to SR 3.0.4 as well.) Where an increase in flexibility was identified, it was evaluated to determine if a Note should be added to the LCO or Required Action to prevent the transition. Categories of MOSCA transitions have been identified as not representing an increase in Mode change flexibility. The attributes of these categories are discussed below. Reference is made to these categories in the evaluation / comment column of the review matrix as NOTE 1, NOTE 2, NOTE 3a, and NOTE 3b.
NOTEI. The Actions in the LCO to be entered ultimately require a shutdown through some Modes in the Applicability. A typical LCO in this category would have a Condition that provided a Completion Time to restore required equipment to operable status, and another Condition that required a shutdown to a Mode for which the LCO did not apply if the equipment could not be restored within the allowed time period. Entering the lower Modes intentionally would not provide increased MOSCA flexibility because the LCO ultimately would require these transitions anyway. An important assumption applied to this category is that any early shutdown (prior to the expiration of the Completion Time of a required shutdown, e.g., day two of an allowed seven-day Completion Time) is not precluded by LCO 3.0.4 in the existing TS.
NOTE 2.
The Actions to be entered require "immediate" exit from the Applicability (e.g., suspend handling ofirradiated fuel - immediately) or "immediate" restoration of the LCO (e.g.,
initiate action to restore subsystem to operable status - immediately). In applying this category, it is necessary that the "immediate" Action be newly applicable, i.e., the Required Action to be entered was not operative prior to the transition. The generic review that was used tojustify the NUREG-1431, Revision i version of LCO 3.0.4 that is under consideration here (BWR-26) considered that such a transition was precluded because it would not be permissible to enter a MOSCA wben the Required Actions would require immediately exiting the MOSCA or immediately initiating action to restore a system or component to operability, flowever, in this plant-specific review, this category was not used as a screen to identify transitions that would not involve increased MOSCA transition flexibility. With some exceptions, these "immediate action" transitions were not considered a relaxation in Mode change restrictions and were evaluated to determine if a Note precluding the transition should be added. The exceptions to this approach were transitions involving movement of fuel or core alterations. Transitions into a MOSCA involving movement of fuel or initiating core alterations were considered as precluded by NOTE 2 if the immediate action was to suspend these activities.

The Required Actions to be entered permit continued operation in the MOSCA. This category of transition is specifically recognized in the text of LCO 3.0.4 in the ISTS, which states:
"When an LCO is not met, entry into a MODE or other specified condition in the Applicability shall not be made except w hen the associated ACTIONS to be entered permit continued operation in the MODE or other specified condition in the Applicability for an unlimited period of time."
Therefore, by the definition of LCO 3.0.4, no restrictions are imposed.
NOTE 3b. Entry into the MOSCA is required by the Required Actions of another LCO. If the transition would be imposed by another LCO, the intentional entry into the MOSCA would not represent an increase in Mode change flexibility. This is consistent with ISTS LCO 3.0.4, which states, in part:
"This Specification shall not prevent changes in MODES or other specified conditions in the Applicability that are required to comply with ACTIONS or that are part of a shutdown of the unit."
A review of the existing VEGP TS was performed and the results are summarized on the enclosed LCO 3.0.4 Evaluation matrix. The matrix columns identify the TS LCO, MOSCA transition, whether a new allowance (increased flexibility) is provided, and whether addition of a Note restricting the transition is recommended.

Request to Revise Technical Sp;cifications Limiting Condition for Operation (LCO) Applicability LCO 3.0.4 Significant flazards Consideration Evaluation Proposed Change The proposed changes would update the versions of LCO 3.0.4 and SR 3.0.4 that appear in the existing Vogtle Electric Generating Plant (VEGP) Technical Specifications (TS) to be consistent with the versions of LCO 3.0.4 and SR 3.0.4 as they appear in Revision I to NUREG-1431, Westinghouse improved Standard Technical Specifications (ISTS). The existing VEGP version of LCO 3.0.4, which was based on Revision 0 to NUREG-1431, states,in part,"This specification shall not prevent changes in MODES or other specilled conditions in the Applicability that are required to comply with ACTIONS." Similarly, SR 3.0.4 states, in part, "This provision shall not prevent entry into MODES or other specified conditions in the Applicability that are required to comply with ACTIONS." The proposed changes would add the words "or that are part of a shutdown of the unit," so that LCO 3.0.4 and SR 3.0.4 would not prevent shutdowns that are not necessarily required by TS Required Actions. In addition, the proposed change would also add the following to LCO 3.0.4:
"LCO 3.0.4 is only applicable for entry into a MODE or other specified condition in the Applicability in MODES 1,2,3, and 4."
Similarly, the following would be added to SR 3.0.4:
"SR 3.0.4 is only applicable for entry into a MODE or other specified condition in the Applicability in MODES 1,2,3, and 4."
The Mode restrictions of the existing VEGP versions of LCO 3.0.4 and SR 3.0.4 are applicable in all Modes. This change has the effect of removing those Mode restrictions from Modes 5 and 6.
Appropriate Ilases language that corresponds to the proposed changes (also taken from Revision 1 to NUREG 1431)is included.
The proposed changes to LCO 3.0.4 and SR 3.0.4 provide additional Mode change flexibility that is not allowed by the existing VEGP TS. This flexibility was evaluated using the methodology described in the following paragraphs, and in some cases this additional flexibility has been determined to be inappropriate. In those cases, Notes restricting this flexibility have been proposed for specific affected LCOs. These LCOs are as follows:
LCO 3.1.1; LCO 3.3.1, Condition C; LCO 3.3.8 Condition A; LCO 3.4.8; LCO 3.4.12; LCO 3.9.1; and LCO 3.9.6 E21 l

1.
Do the proposed changes involve a significant increase in the probability or consequences of an accident previously evaluated?
I No. The proposed change has impact on what equipment is required to be OPERABLE or demonstrated OPERABLE via surveillance prior to unit shutdowns or entry into MODES 5 and 6.
This change could increase the probability or consequences of an accident previously evaluated if applied without consideration to all applicable transitions. Ilowever, as part of the change, an evaluation is attached in the form of a matrix that identifies those specifications to which LCO 3.0.4 and SR 3.0.4 must continue to apply. Therefore, only those specifications that do not impact safety for these plant conditions are afforded this relaxation. As such, there is no increase in the probability or consequences of an accident previously evaluated as this assessment has been performed and documented with the submittal.
2.
Do the proposed changes create the possibility of a new or different kind of accident from any accident previously evaluated?
No. The proposed change administratively changes when equipment is required to be OPERABLE or demonstrated OPERABLE via surveillance prior to unit shutdown or entry into MODES 5 and 6.
Ilowever, as no changes in equipment function or operation are included, there is no increase in the probability of a new or different kind of accident from those previously evaluated.
3.
Do the proposed changes involve a significant reduction in a margin of safety?
No. The proposed change has impact on what equipment is required to be OPERABLE or demonstrated OPERABLE via surveillance prior to unit shutdown or entry into MODES 5 and 6.
This change could impact the margin of safety of some accidents if applied without consideration to all applicable transitions. Ilowever, as part of the change, an evaluation is attached in the form of a matrix, that identifies those specifications to which LCO 3.0.4 and SR 3.0.4 must continue to apply.
Therefore, only those specifications that do not impact safety for these plant conditions, which includes any impact on margin of safety are afforded this relaxation. As such, there is no reduction in the margin of safety.
Conclusion Based on the preceding evaluations, the proposed changes do not involve a significant increase in the probability or consequences of any accident previously evaluated, do not create the possibility of a new or different kind of accident from any accident previously evaluated, and they do not involve a significant E2-2
