MEETING WITH THE DETROIT EDISON COMPANY TO DISCUSS THE FERMI 2 IMPROVED STANDARD TECHNICAL SPECIFICATIONS CONVERSION l The NRC staff met with DECO at NRC Headquarters on March 19,1999, to discuss issues related to the Fermi 2 submittal for the conversion to the improved standard technical specifications (ITS). Enclosure 1 lists the meeting participants. The primary focus of the l

meeting was to discuss the proposed questions for a request for additionalinformation (RAl) for .

I l Section 5.5.14 of the conversion related to the configuration risk management program (CRMP) that exists in current technical specification (CTS) 6.8.5.h. The proposed questions l (Enclosure 2) were faxed to the licensee prior to the meeting.

1 i Tha licensee presented the history behind the introduction of the CRMP into the CTS through Amendment No.119, issued on June 2,1998. See Enclosce 3 for the licensee's handout used during the meeting. The presentation clarified the basis for the licensee's belief that the CRMP would only be applied for extended emergency diesel generator (EDG) outages and that it need not be applied to short-duration outages (e.g., monthly EDG testing). In particular, the licensee i pointed out that its submittal dated April 27,1998, that requested the addition of the CRMP,

, specifically stated the licensee's intention to apply the CRMP only to extended outages. The I

licensee agreed that the staff had presented its position (that the CRMP applied to all EDG

outages, of any duration) during phone conversations preceding the issuance of the amendment. However, the licensee considered the lack of any NRC comment on the statement in its submittal as indication that the staff did not object further to the licensee's interpretation.

l The staff acknowledged the information presented by the licensee. The staff then explained that, for its part, it had approved the amendment based on its belief that the TS would require the application of the CRMP for any EDG outage (see the proposed questions in Enclosure 2).

The staff acknowledged that the docketed record was ambiguous since the staff did not respond i to the statement in the licensee's submittal. However, the staff pointed out that the TS l requirements could not be modified by the licensee's letter or the Bases. The staff also l

recognized that the licensee's current methods for managing risk, which include evaluating the risk for all safety system outages, would ensure that the evaluations required by the CRMP for planned outages are performed regardlest of whether the CRMP was applied.

With respect to the conversion, the staff explained that changes to the CTS version of the -

CRMP, other than adjusting the wording to account for ITS terminology, would be considered a beyond scope issue that would require a detailed review by the staff and could potentially lead '

to delays in the review process. However, the staff also pointed out that a pending change to the Maintenance Rule (10 CFR 50.65) would make the risk evaluations for all system outages a p p requirement. At this point the CRMP would no longer be necessary because it would duplicate the requirements in the rule. If the rule change occurs before the conversion is completed, the l licensee would likely have the option of removing the CRMP from the TS. However, if the rule l n<

change is not completed in time for the conversion, the staff proposed, and the licensee agreed, that the CTS version of the CRMP would be translated into the ITS. These two alternatives will avoid the need for an extended review of proposed changes to the CRMP that might delay the conversion. Either approach would resolve the proposed RAI questions.

Based on the discussion in this meeting, the staff determined that it will not be necessary to issue the proposed RAl. The issue will be resc!ved through one of the two alternatives presented above.

During the discussion, the licensee raised another issue related to the current TS for the EDGs.

CTS Action 3.8.1.1.b.2 requires the licensee to periodically verify the operability of combustion turbine-generator 11-1 when an EDG is inoperable. The licensee pointed out that, in its April 19, 1996, and January 30,1997, letters addressing this verification, it had stated that this verification would be performed for extended (i.e., greater than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />) EDG outages. However, in the proposed questions the staff stated that the verification is required whenever an EDG becomes l inoperable. The staff acknowledged that the submittalletters included the statements about extended outages. However, the TS action statement, which was written by the licensee and approved by the staff, failed to include any such conditions. The staff stated that if the licensee desires to correct this action statement, it should do so through a license amendment i application. This action would be separate from the TS conversion.

REQUEST FOR ADDITIONAL INFORMATION REGARDING CONVERSION TO IMPROVED STANDARD TECHNICAL SPECIFICATIONS, SECTION 5.5.14 FOR FERMI 2 (TAC NO. MA1465)

General Note Throughout this request for additional information (RAI), references to an improved TS (ITS) mean the proposed converted TS. Also, references in these RAls to declaring one diesel inoperable would also apply if both diesels in a division were declared inoperable. The current TS (CTS) and ITS treat one or both diesels in a division inoperable the same way.

RAI 5.5.14-1: You proposed to modify CTS 6.8.5.h.1 in the conversion by the removal of the phrase "The assessment shall be." Discussion of Change (DOC) A.12 indicates that this change is editorial. However, the staff does not consider this change editorial. The first sentence in CTS 6.8.5.h.1 discusses the control and implementation of a level 1, at-power, intemal events methodology. The second sentence discusses associated assessments. i Therefore, the sentences cannot be combined as proposed. Similarly, the ITS included a I proposal to replace (1) the CTS 6.8.5.h.3 phrase " entry into the LCO [ limiting condition for '

operation] ACTION STATEMENT" with " events" and (2) the term " additional" in CTS 6.8.5.h.4 with " subsequent." Neither of these changes is justified in DOC A.12 and the staff believes these changes could be interpreted to change the intent of the CTS. Comment: Retain the wording in the CTS. In the case of the CTS term " Action Statement," the ITS equivalent would be " Condition."

l RAI 5.5.14-2: The ITS included a proposal to replace the phrase *LCO ACTION STATEMENT" with " applicable risk-informed Completion Time." This change is not correct and could be misleading in that it implies application of the configuration risk management program (CRMP) is dictated by the Completion Time. The appropriate change would be to replace the phrase "LCO ACTION STATEMENT" with " applicable Condition" (e.g., Condition A in ITS 3.8.1). Comment:

Adopt the appropriate wording to replace the phrase "LCO ACTION STATEMENT."

RAI 5.5.14-3: Throughout the submittal for the conversion of CTS 6.8.5.h and the associated DOC A.12, you present the view that the CRMP only applies if the diesel outage is planned for greater than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />. DOC A.12 indicates that for outages of less than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> the CRMP does not need to be implemented. This interpretation is incorrect. Specifically:

1. DOC A.12 states that CTS Action 3.8.1.1.b.2 is not entered if the combustion turbine-generator (CTG) is not operable or not verified to be operable (emphasis added).

This implies that a lack of action (not doing the verification) avoids entry into Action 3.8.1.1.b.2, leading directly to Action 3.8.1.1.b.3. In fact, Action 3.8.1.1.b.3 provides an attemative action only if "the requirements of ACTION b.2. above for CTG 11-1 cannot [ emphasis added] be met." Action 3.8.1.1.b.2 is not optional and action 3.8.1.1.b.3 is only entered if the CTG cannot be verified operable. Therefore, any time CTS Action 3.8.1.1.b is entered (for an inoperable diesel), Action 3.8.1.1.b.2 is entered and the CRMP must be applied. If, after entering Action 3.8.1.1.b.2 (and applying the CRMP), the CTG cannot be verified operable, then you would enter Action 3.8.1.1.b.3.

2. DOC A.12 indicates that the CRMP does not apply to Action 3.8.1.1.b.3. This is based, at least in part, on CTS 6.8.5.h which lists Specification 3.8.1.1.b.2 as the risk-informed allowed outage time that has been granted. However, Action 3.8.1.1.b.3 includes permission to have up to 7 days of Allowed Outage Time (AOT) if the CTG is restored.

Thus, Action 3.8.1.1.b.3 is based on the risk information supplied by you and reviewed by the NRC for Amendment No.119 which extended the diesel AOT and added the CRMP. Action 3.8.1.1.b.3 cannot be separated from the risk issue and the CRMP. The staff's view of the specific listing of Action 3.8.1.1.b.2 in CTS 6.8.5.h is that this is the action through which the AOT is entered. Action 3.8.1.1.b.3 is entered only through Action 3.8.1.1.b.2.

3. Finally, DOC A.12 indicates that the CRMP only applies after a 72-hour period allowed for determining that CTG 11-1 is operable. This view is also reflected in section 5.5.14.a of the proposed ITS. However, Action 3.8.1.1.b.2 requires verifying the CTG is operable within 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> of declaring a diesel inoperable and at least once per 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> thereafter.

DOC A.12 does not reflect this requirement.

Comment: Revise DOC A.12 and the ITS description of the CRMP to correctly reflect the CTS requirements.

The staff recognizes that some of the wording in the CTS could be misinterpreted. However, as discussed above, if CTS Action 3.8.1.1.b and 6.8.5.h are reviewed as a whole, it becomes clear that the CRMP must be applied whenever a diesel is inoperable. In addition to the discussion above, CTS 6.8.5.h states, in part; 1

The program applies to technical specification structures, systems, or components for which a risk-informed allowed outage time has been granted This CTS statement, in conjunction with the Information discussed in the RAls above, clearly indicates that the application of the CRMP is tied to the act (planned or unplanned) of taking the

associated equipment out of service andnqt to the length of time the equipment is expected to l be out of service. Note that CTS 6.8.5.h.3 provides special provisions for cases in which the l outage is unplanned.

This statement is incorrect and is in direct conflict with CTS Action 3.8.1.1.b.2 which requires the performance of this verification any time a dieselis declared inoperable. The conversion of the CTS to the ITS provides an opportunity to correct this error.
