Dear Mr. Port:
This is in response to your letter dated January 23, 1987, in which you requested, pursuant to the Freedom of Information Act (F0IA), quarterly reports of transfers of devices distributed under general licenses between the first quarter of 1980 through the last quarter of 1986.
Records subject to your request were previously requested under an earlier F0IA request (F01A-86-413) from your associate Mr. Kenneth White. Copies of our responses to Mr. White's request are enclosed. Copies of the released records are maintained at the NRC's Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555, in file folder FOIA-86-413. Enclosed is information on how you may obtain copies of these records.
At this time, the remaining quarterly reports are being withheld from public disclosure pursuant to Exemption (4) of the FOIA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.
Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Hugh L.
Thompson, Director, Office of Nuclear Material Safety and Safeguards.
This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
The review of the remaining quarterly reports is continuing.
In the event additicnal records are released, they too will be placed into the PDR under F0IA-67-64.
