HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING OCTOBER 28, 1988 Sequoyah Fuels Purchase By General Atomics ,

By separate letters dated October 18 1988, Sequoyah Holding Corporation, a subsidiaryofGeneralAtomics,formallyrequestedNRCapprovalofthepurchase of Sequoyah Fuels by Sequoyah Holding from Kerr-McGee Corporation and a license amendment to reflect organizational and corporate oversight changes resulting from the proposed transfer of control. As requested by staff, Sequoyah Holding has provided additional information and comitments related to decommissioning fu r.d i ng. Staff is preparing an assessment for the proposed transfer of control of the license.

Southwestern low-Level Radioactive Waste Disposal Compact Consent Act The Senate passed the Southwestern Low-level Radioactive Waste Disposal Compact Consent Act (S. 5232) on October 21, 1988. The House approved an identical bill (H.R. 5232) on Ser,,tember 26. The President is expected to sign the legislation by October 31, thus acknowledging Congressional consent to the Compact of the eligible States of California, Arizona, North Dakota and South Dakota. To date, California and Arizona have enacted the required State legislation. South Dakota is expected to introduce such legislation in 1989. North Dakota is currently negotiating a contract for the short tem with the Northwest Compact, but may wish to join the Southwestern Compact for the long term. Under the terms of the Compact, California is the host State for 30 years.

California is developing a site at Ward Valley which is 25 miles west of.

Needles. The forecast time for operation is during 1991.

A1 Chem!E The IMNS staff issued two Safety Evaluation Reports (SERs) in connection with Alchem!E's proposals to enrich stable isotopes at facilities in Oak Ridge and Oliver Springs Tennessee. The recently received ACRS letter, which contained favorable comments on the proposals, was enclosed with the SERs.

The staff plans to issue in the near future supplements to the SERs discussing conclusions with respect to financial information.

Supervisory Drug and Alcohol Training A pilot session of the Supervisory Drug and Alcohol Training was presented to approximately 30 managers and supervisors selected from the various offices within NRC, on Thursday October 27, 1988. Trainers were Willard O. Foster of Triton Corporation and Pat Kaplan of the Employee Assistance Program Office of Personnel. Participants were requested to provide coments and recomendations on the program which will be presented to all NRC ranagers and supervisors in Headquarters and the Regions.

O O OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending October 28, 1988 LOW-LEVEL WASTE MANAGEMENT Staff Evaluation of Waste Cement Solidification at West Valley The LLWM staff's technical evaluation of the cement solidification of the decontaminated supernatant waste for the West Valley Project is nearing 's completion. The staff's evaluation is directed at assessing whether DOE efforts in solidifying the decontaminated supernatant will produce a stable waste form that fulfills the requirements of 10 CFR Part 61. Completion of the evaluation report is scheduled for November 1988.

Regional Workshop on Decommissioning Rule A series of workshops is planned for NRC Regional materials licensing staff to familiarize them with the requirements of the decomissioning rule issued by the Comission in June 1988.

The first workshop is scheduled for Region I on November 1,1988, and will discuss provtsions of the rule requiring financial assurances for decomissioning and acceptable mechanisms for meeting these reqairements. The workshops will be conducted by staff of the Division of low-Level Waste Management and Decomissioning in HMSS.

INDUSTRIAL AND MF. DICAL NUCLEAR SAFETY Fuel Cycle Safety Sequoyah Fuels Purchase By General Atomics By separate letters dated October 18 1988, Sequoyah Holding Corporation, a subsidiary of General Atomics, formally requested NRC approval of the purchase of Sequoyah fuels by Sequoyah Holding from Kerr-McGee Corporation and a license amendment to reflect organizational and corporate oversight changes resulting from the proposed transfer of control. As requested by staff, Sequoyah Holding has provioed additional information and comitments related to decomissioning funding. Staff is preparing an assessment for the proposed transfer of control of the license.

Environmental Assessment For Oconee ISFS!

The NRC has issued an Environmental Assessment and Finding of No Significant Impact related to the licensing of a Dry Independent Spent fuel Storage In-stallation (ISFSI) st Duke Power Company's Oconee Nuclear Station. The ISFSI is to use the NUTECH Horizontal Modular System, NUHOMS-24P design. The NUHOMS-24P design stores 24 PWR spent fuel assentlies sealed in a stainless steel canister. 2 concrete module. Duke Power Ccepany has requested licensing for up to 88 modules to >rovide spent fuel storage capacity for its Oconee Nuclear Station throug1 the year 2003.

SAFEGUARDS Domestic Safeguards Staff Participating in Measurement Centrol Symposium At Savannah River Plant Members of the fuel f acility safeguards licensing staff participated in a 00E sponsored symposium on Measurement / Measurement Control for Material Control and Accounting on October 25-28, 1988 at the Savannah River Plant.

Measurement Control is a quality assurance program for SNM neasurements. The current regulations,10 CFR Part 70 and Part 74, require fuel facility licensees to maintain an approved measurement control program. The DOE sponsored symposium provides a forum for DOE and its contractors, NRC and NRC licensees to discuss experiences and new ideas in this technical area.

Inte. national Tracking of Australian Origin Monazite Ore On October 24, 1988, staff attended a meeting at the Department of State with representatives of the Australian Govern.nent to exchange views on the reporting of Australian origin monazite ore imported into the U.S. pursuant to the U.S./

Australian Agreement for Cooperation. Procedures concerning the transfer and accountability of ore containing more than 0.051 by weight of uranium and/or thorium are still being negotiated.

U.S. and Canadian Support Program Consultation Meeting On October 25, 1988, a SGTR staff rember participated in the anr,ual U.S. and Canadian support progran consultation meeting at the Department of State.

The meeting was devoted to the status of safeguards equipment development by the U.S. and Canadian suppurt programs to strengthen IAEA safeguards. The l Canadians presented several types of specialized equipment for safeguarding CANDU reactors.

TRANSPORTATION Installation of QAD and ORIGENS [

On October 24-25 1988, the Transportation Branch met with Dak Ridge National i Laboratory (ORNL! on the installation of QAD and ORIGENS computer programs in (

SGTR. The QAD program is used for neutron and gamma-ray shielding calculations.  !

The ORIGEN5 program can be used to predict concentrations of fission products t and actinide elements for various degrees of fuel burnup, and is able to predict ,

decay product concentrations for various fuel cooling times. The output from ORIGENS can be used strectly in QAD for solving shielding problems involving spent fuel transport casks. L l

Jordan, Director, AE00, will be participating at the National Emergency Management Association Annual Fall Conference in Kansas City, Missouri, on October 30, 1988 and will be tvavelling to Grand Gulf, with the CRGR members, on November 1-3, 1988 for a plant visit.

Diagnostic Evaluation and Incident Investination Branch (DE!!B)

On October 23, 1988, the Fermi Diagnostic Evaluation Team (DET) met with the EDO and DEDO to present and discuss the major findings and conclusions in each of the functional areas evaluated by the team. The Team manager also presented a sumary of the overall findings and conclusians which will be discussed with the licensee on November 1 at the Fermi Site. The Deputy DEDO, Director, AE00, l Region !!! Administrator, and Deputy Team Manager will also be in attendance at l the exit meeting. During October 23-28, the team worked on finalizing the

, evaluation report, including incorporating coments from the Director and Deputy Director, AEOD.

On October 28, 1988, the Director, AE00 and McGuire DET deputy team manager l attended a meeting with Duke Power executives to discuss Duke's Quality Assurance philosophy and program. The meeting was requested by Duke in response to the McGuire Diagnostic Evaluation and Catawba Quality Verification inspection.

ITEMS OF INTEREST OFFICE OF GOVERNMENTAL AND PUBLIC AFFAIRS WEEK ENDING OCTOBER 28, 1988 INTERNATIONAL PROGRAMS:

Foreign Visitors un Monday Mr. Thilo Schelling and Dr. K. Kugler of the staff of Dr. Reimut Jochimsen, Minister for Economics and Technology of the West German State of North-Rhein-Westfalia, accompanied by Dr. Heinz Seipel, Science Counselor at the FRG Embassy in Washington, visited RES staff to discuss several technical issues concerning site criteria, plant backfitting, PSA, and safety research and licensing of liquid metcl cooled reactors. Note: Dr. Jochimsen, the State official responsible for refusing to grant an operating lict.nse to the Kalkar SNR-300 fast breeder reactor, did not attend.

On Monday Mr. Jose Izquierdo of the Consejo de Seguridad Nuclear in Spain met with GPA/IP and NRR staff to discuss BWR instabilities after the LaSalle incident and the impact of steam generator tube plugging on transient and accident analysis review of D3.F.51 steam generator of Westinghouse three-loop plants.

On Friday Mr. Noramly bin Muslim, Deputy General for Technical Cooperation at the International Atomic Energy Agency (IAEA) in Vienna, met with Chairman Zech, Comissioner Rogers, Harold Denton of GPA, Jim Shea of GPA/IP, and other GPA/IP staff to discuss the IAEA's technical cooperation program.

STATE, LOCAL AND INDIAN TRIBE PROGRAMS Southeast Low-Level Radioactive Waste Compact Comission Meeting Robert Trojanowski, Director of the Region II State and Government Affairs Staff, attended the Southeast Compact Comission for Low-level Radioactive Waste Management Annual Meeting on October 24-25, 1988 in Roanoke, "irginia. Kathryn Visocki was elected Executive Director of the Compact ' mission. She replaces Robert Wolle, who resigned for health reasons. Representatives from North Carolina made a presentation on the status of the State's effort to site a LLW disposal facility. The State has met all its milestones to date and intends to have a disposal facility in operation by January 1, 1993. North Carolina intends to issue a contract for site selection on December 1,1988; choose a site operator by January 31, 1989 and nominate at least two and perhaps more sites for site characteri . tion by August 1,1989. The Compact Comission agreed to coment on the NRC proposed rule to reassert NRC's tole authority for approving onsite LLW disposal in Agreement States.

The Commission will oppose the propost ? eule change for a variety of reasons including its t.elief that the Low"Level Radioactive Waste Policy OCTOBER 28, 1988 ENCLOSURE F

2 Act and the ~985 Act Amendments make low-level waste disposal a State responsibility and that the proposed rule is ambiguous.

Meetings with Montana, Utah and Wyoming State Officials John Montgomery, Region IV Deputy Administrator, and Charles Hackney, Region :V State Liaison Officer, met with the State Liaison Officers from Montana, Utah and Wyoming on October 24, 25 and 26,1988, respectively.

The meetings provided an opportunity to discuss Agreement State issues, low-level waste issues arid NRC/ State interface. Emergency response for transportation accidents was also discussed.

Texas LLW Disposal Status Report Rick Jac ei, General Manager of the Texas Low-Level Radioactive Waste Disposal Authority, visited the Reofon IV office on October 27, 1988 to brief Region IV staff on the status of efforts in Texas to site and develop a low-level waste disposal facility.

Low-Level Radioactive Waste Forum Steve Salomon, SLITP, attended the quarterly meeting of the LLW Forun held in Knoxville, TN, October 17-10, 1988. Compact and State representatives heard presentations by NRC, DOE and the sited States on the 1990 Congressional milestone pertaining to Governors' Certifications for proposed storage, disposal or management actions in lieu of appli-cations for disposal facilities. George Pangburn, Paul Lohaus, and Malcolm Knapp, all from the Division of low-Level Waste Management and Decommissioning, represented NRC in these discussions. Staff estimates that 32 States will submit Governors' Certifications. Only Texas will submit a complete license application. The Southwestern and Central-Midwest Compacts are expected to submit license applications for OCTOBER 28, 1988 ENCLOSURE F

Other subjects of concern to the States that were 61scussed in'lude the progress being made by EPA in its LLW standard, and the impediLants that mixed and NARM waste controversies may cause in timely disposal operation. Generally, most of the States and compacts reported steady progress toward creating new disposal capacity. ,

LLW Forum participants made site visits on October 19 to the w k Ridge National Laboratorv X-10 waste storage and disposal facilities and the Y-12 waste disposbl facility and remediatire projects. Of special interest to the States is the DOE adaptation of the French earth-mounded concrete bunker disposal facility, the LLW silos, and the Toxic -

Substances Control Act (TSCA) incinerator for mixed waste. In addition, the Quadrex decontamination and processing facility and the Scientific Ecology Group supercompactor and waste oilburner facilities were visited.

Some of these techNlogies are of interest to the States and the issue of technology transfer from the Federal government to the States was explored.

Meeting of Pennsylvania LLW Advisory Comittee On October 25-26, 1988, Juhn McGrath, Regional 3 tate Agreements Officer, attended a meeting of the Pennsylvania Low-Level Radioactive Waste Public Advisory Comittee, h* McGrath made a presentation on the NRC Agreement States program emphasizing limited Agreement State status. It is the ,

State's intention to pursue limited Agreement State status for the

. licensing of a LLW disposal facility. Pennsylvania is the host State for I the Appalachian Compact. The Comittee membership had questions regarding the agreenent process, State flexibility regarding compatibility requirements and the status of the State's regulatirsns which have undergone NRC review. The Comittee also discussed the process and schedule for Committee review of operator bid proposals. The proposals are due on November 9, 1988. Public meetings, during which

! bidders will discuss their proposals and answer questions, will be held during the month of December. An operator will be selected and a contract executed by late spring, 1989. The operator will be selected by the Secretary, Department of Environmental Resources, after consideration of reports submitted by the Department staff, the Public Advisory Comittee and coments submitted by the public.

OFFICE OF PERSONNEL ITEMS OF INTEREST Week Ending October 28, 1988 Arrivals and Departures Four new employees joined the staff this week: Linda Kasner, Health Physicist (Medical) for Region IV; Inez Johnson, Travel Clerk, for Region II; and Gisela Abruscato, Secretary for NMSS. Sherry Matz, a part-timer, joined Region III as a Resident Clerical Aide.

Departures included three employees from NRR: Oliver Lynch, Section Chief; Eileen Cokenias and Carolyn Williams, both secretaries. Region I losses were Alan Luptak, Sr. Resident Inspector and Julie Madden, Physical Security Irspector.

Supervisory Drug and Alcohol Training A pilot session of the Supervisory Drug and Alcohol Training was presented to approximately 30 managers and supervisors selected from the various offices within NRC, on Thursday, October 27, 1988. Trainers were Willard O. Foster of Triton Corporation and Pat Kaplan of the Employee Assistance Program, Office of Personnel. Participants were requested to provide coments and recommendations on the program which will be pretented to all NRC managers and supervisors in Headquarters and the Regions.

Job Fairs An OP representative participated in the "Job Fair for Mature Workers" on October 26, 1988. The Job Fair, sponsored by the Montgomery County Department of Family Resources, Division of Elder Affairs, was held at the Charles E.

Woodward High %.noc' in Rockville. Approximately 40 companies and Federal Agencies were represented. Participating individuals represented a wfde spectrum of occupations.

A recruiting team composed of Gloria Heckstall, OP, and Deborah Jackson, Project Engineer, NRR attended the Mid-Atlantic Region Conference for the Society of Women Engineers in College Park on October 28, 1988. This event was sponsored by the University of Maryland, Department of Engineering.

The Ordar requires the licensee to obtain independent consulting services to p(erform EN88-91) audits for two years to evaluate adherence to NRC requirements.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $150,000 was issued on October 25, 1988 to Nebraska Public Power District (Cooper). The action was based on violations of the equipment qualification requirements of 10 CFR 50.49. Because of the licensee's failure to take corrective actions for the violations as well as the fact that NRC identified all of the violations, the base civil penalty was escalated 100%. (EN 88-88)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $500 was issued October 27, 1988 to Ford Motor Company,

The action was based on a violation involving the improper disposal of a generally licensed nuclear gauge containing approximately one curie of americium-241. (EN 88-90)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $500 was issued October 27, 1988 to Devis Great Guns Logging, Wichita, Kansas. Civil Penalties Paid Wise Appalachian Regional Hospital, Wise, Virginia paid the proposed civil nalty in the amount of $1,250. The action was based on failure to:

label syringes or syringe shields containing radiopharmaceuticals, label vial radiation shields that contain a vial of radiopharmaceuticals, issue written permission to a visiting physician as an authorized user, post a restricted area, (5) conduct a quarterly Radiation Safety Committee meeting, (6) perform a formal annual review of the radiation safety program, (7)

(8) provide perform in-service and initial quarterly dose calibrator training linearity to ancillary personnel, tests. The base civiland penalty was decreased by 50% based on the licensee's prompt and extensive corrective actions. (EA 88-204)

Baltimore Gas and Electric Company (Calvert Cliffs Units 1 and 2) paid the proposed civil penalty in the amount of $150,000. The action involved two events in which Technical Specification Limiting Conditions for Operation were violated. In the first, one of the two emergency diesel generators required for Unit 2 was inoperable for approximately 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> because the voltage regulator was left in manual after testing. In the second, all the variable high level and axial offset Reactor Protective System instrumentation ,

channels on Unit I were set less conservative than required. The base civil penalty was escalated 50% because of prior poor performsnee in the first violation and prior notice of a similar problem in the second violation. ,

Pennsylvania Power and Light Company (Susquehanna Units 1 and 2) paid the proposed civil penalty in the amount of $50,000. The action was based on a violation of the equipment qualification requirements of 10 CFR 50.49.

The action was based on two separate l examples of inattentiveness on the part of security officers assigned as l compensatory measures for an unlocked and unalarmed vital area door. (EA 88-174) l Payne and Payne, Inc., Shawnee, Oklahoma paid the proposed civil penalty in the amount of $1,600. The action was based on failures to calibrate, perform surveys, evaluate personnel dosimetry, leak test and inventory sea'ed sources, enter into an agreement with well operators as owners or to responsibilities in event of a down-hole irretrievable source, and follow DOT regulations. 2. On October 25, the Director, State and Government Affairs Staff attended a meeting of the Southeast low Level Waste Compact Comission in Roanoke, Virginia.
3. During the week of October 24, the Agreement States representative con-ducted a mid-review visit of the North Carolina Agreement State Program in Raleigh, North Carolina.
4. On October 26, the Acting Regional Administrator and selected members of the Region 11 staff were in Headquarters to participate in a meeting with NRR and representatives of the Virginia Electric and Power Company regarding their Surry Nuclear Power Station.
5. On October 27, the Act'ng Regional Administrator was in Headquarters to participate in a meeting with VEPC0 management, the Office of Executive Director for Operations, and the Office of Nuclear Reactor Regulation.
6. On October 27, representatives of the Duke Power Company were in the Region II Office to attend an Enforcement Conference regarding issues surrounding operability of the Hydrogen Skimer System and installation and testing of plant modifications at their McGuire Nuclear Power Station.
7. On October 27, the Director, Divsion of Reactor Projects, was in Head-quarters to meet with NRR regarding discussion issues for the December Senior Management Meeting.

Region IV Items of Interest Week Ending October 28, 1988

1. State Meetings The Region IV Special Assistant and the Regional State Liaison Officer met with representatives from the states of Montana, Utah, and Wyoming on October 24, 25, and 26 and discussed Agreement States issues, low-level waste, and NRC state interfaces.
2. NMSS Assessment Hugh Thompson, the Director, Office of Nuclear Materials Safety and Safeguards, and Richard Cunningham, Malcolm Knapp, and Jesse Funches of his staff visited Region IV on October 25 for discussions on NMSS programs with regional management involved in NHSS programs.
3. Visit with Texas State Official Mr. Rick Jacoby, General Manager, Texas Low-Level Radioactive Waste Disposal Authority, visited the Region IV office on October 27 and met with the Regional Administrator, Special Assistant, and other Region IV senior managers to discuss low-level waste disposal issues and the development of the Texas low-level waste disposal site. Mr. Jacoby also met with the Region IV technical staff to discuss site development and operational procedures of the Texas low-level waste disposal site.

(2) Specifically vacates the Appeal Board'c order that authorization of low-power operation may not be given effect until the contested issues about such a system are resolved favorably for Seabrook.

(3) Directs the Chairman of tne Atomic Safety and Licensing Board Panel, in consultation with the Seabrook "onsite" and "offsite" Atomic Safety and Licensing Boards, to determine which of those Licensing Boards should try the prompt notification issues.

Commissioner Roberts was on travel and unavailable to participate.
