Dear Mr. President:

Pursuant to Subtitle E of the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801 (Act), the Nuclear Regulatory Commission is submitting changes to the NRC's Enforcement Policy. These changes establish an interim enforcement policy for users of certain industrial devices containing NRC-regulated material. The NRC anticipates that these users may discover violations of NRC requirements as a result of proposed new NRC regulations. The interim policy provides relief from NRC enforcement action for such violations.

We have determined that this action (iriterpreted as a " rule" under the Act) is not a " major rule" as defined in 5 U.S.C. 804(2). This determination was made under a generic approval by the Office of Management and Budget for this type of action.

Enclosed is a copy of the final action, which hcs been transmitted for publication in the Federal Register. This action is effective immediately upon publication.
