In accordance with the requirements of 10 CFR 50.55(e), the following report is submitted. This is a final report. O P Gormley (Vendor Program Branch) requested copies of the material test reports for the orifice flanges supplied to Midland. This letter transmits the copies he requested.

Description of Concern A copy of a Part 21 Notice was received by CPCo from Consolidated Pipe and Valve Supply, Inc indicating a potential problem with Certified Material Test Reports for material furnished to the Midland Energy Center. This material was originally purchased by Consolidated Pipe and Valve from Golden Gate Forge

& Flange, Inc, located at Hunters Point, San Francisco, California. The president, vice president and shipping foreman all of Golden Gate Forge &

Flange, Inc, have been indicted and charged in federal court on conspiracy and making criminal false statements in connection with falsified test certifica-tions (Mill Test Reports). The potentially affected material, which is not installed, consists of 6-raised face orifice flanges.

Safety Impact It is indeterminate what the safety impact of this condition would have been, had the materials been installed in safety applications.

Root Cause It is not known if the materials supplied are in fact in nonconformance with specified engineering properties. The root cause of the potentially reportable condition is fraudulent action on the part of Golden Gate Forge which makes the materials supplied to Midland suspect.

Serial 32646 86-03 #1 Corrective Action A nonconformance report has been written. . The subject material has been statused and segregated per the QA procedures thus preventing its use in a nuclear application. The remaining action would be to close out this subject with your office if the Midland Energy Center is reactivated. This itert will be entered in our Correspondence and Commitment Management system for long-term tracking.
