Good afternoon, ladies and gentlemen.

3 This is an affirmation session, and we have one item 4

before us this afternoon.

5 Before I ask the Secretary to lead us through the 6

item, do any of my fellow Commissioners have any remarks to 7

make?

8 COMMISSIONER ASSELSTINE:

No.

9 CHAIRMAN ZECH:

If not, Mr. Hoyle, would you please 10 lead us through the affirmation item?

11 MR. HOYLE:

Thank you, Mr. Chairman.

12 The item for affirmation is SECY 87-44.

The title is 13 Final Rule Revising Commission Code of Conduct Rules on Fuel l

14 Cycle Prohibited Securities and Vested Pension Exemptions.

15 The Commission is being asked to approve amendments 16 to 10 CFR Part 0 which (1) narrow the scope of the regulation 17 so that only the major companies engaged in nuclear fuel cycle 18 activities are placed on the Commission's prohibited stock 19 list; and (2) provide explicitly that no employee is to provide 20 advice to the NRC on matters affecting a company on which he or 21 she has a vested pension interest unless an exemption has been 22 granted the employee.

23 The Chairman and Commissioner Bernthal and 24 Commissioner Asselstine have approved the rule as far as 25 providing explicitly that no employee is to provide advice.

Commissioner Asselstine would keep the broad scope of 2

the regulations as presently applied to fuel cycle activities.

3 Commissioners Roberts and Carr, who are not present 4

today, would have approved both parts of the rule change.

5 May I have the Commissioners' affirming votes?

Aye.
