Attorney Irving first apprised the Board during the conference that l

Applicant's contract with the Department of Energy to acquire the j i

l subject technology required it to receive the construction pennits  !

I applied for by November 20, 1988. Applicant's purpose in requesting the  !

conference was to ask for expedited processing of the applications by Staff and an early hearing date, preferably prior to November 20, 1988.

Staff advised as to how it was preparing its reviews as expeditiously as is possible. The Board informed Attorney Irving that it too would act expeditiously on the application but that no adjudicatory decision can be forthcoming where the parties are still in the process of compiling the evidence to be presented.

The Board approved the holding of a prehearing telephone conference at 2:00 p.m. on November 9 to discuss future scheduling. This confirmed the conference the Board called for in a letter of October 28, 1988, which the parties had no't received.

Applicant inforwed the Board that it was seeking an extension of the November 20 date and hoped that a decision would be obtained by the Department of Energy by November 9.

The Board was agreeable to scheduling the start of the hearing prior to November 20 to accommodate AlchemIE. However, 10 C.F.R. 2.104 requires that prior to holding the initial hearing, the public must be given notice by publication in the Federal Register, no less than 30 j day'; in advance of the hearing. l i

D The Board and the parties agreed to scheduling the connencement of the initial hearing on December 21, 1988 at Knoxville, Tennessee, which i will follow the publication of the required Federal Register notice. -
