MODIFICATION NO. 3 TO TASK ORDER NO. 021 UNDER CONTRACT NUMBER NRC-03-98-021

Dear Ms. Beckraan:

The purpose of this modification is to add Task B, D.C. Cook QA Oversight inspection in accordance with the enclosed Statement of Work. Task B is effective March 27,1999. There is no change in the period of performance as a result of the additional work. However, there is a ci ange in the cost ceiling. Accordingly, the task order is modified as follows:

"The task order cost ceiling is increased by $86,818.35, from $182,245.41 to $269,063.76. The total cost ceiling is composed of $260,594.44, which represents the estimated reimbursable costs, and the amount of $8,469.32 represents the fixed fee."

The following individuals are considered to be essential to the successful performance of Task B:

Mr. Robert Quirk and Mr. Charles Jones. The Contractor agrees that such personnel shall not be removed from the effort under the task order without compliance with Contract Clause H.4A Personnel.

I Funds in the amount of $182,245.41 are currently obligated under this task order. The obligated amount shall, at no time, exceed the task order ceiling. When and if the amount (s) paid and payable to the Contractor hereunder shall equal the obligated amount, the Contractor shall not be obligated to continue performance of the work unless and until the Contracting Officer shall I

increase the amount obligated with respect to this task order. Any work undertaken by the Conractor in excess of the obligated amount specified above is done so at the Contractor's sole risk 33,,,

The issuence of this task order modification does not amend any terms or conditions of the subject contract.

Martin Farber, R 111 (630) 829-9734 PERFORMANCE PERIOD: September 18,1998 - June 30,1999 OBJECTIVE The objective of this task order is to obtain expert technical assistance in the areas of instrumentation and control (l&C)/ electrical and mechanical design. Three specialists are needed to assist the NRC inspection team in the QA ov rsight oflicensee activities. The two specialists (l&C/ electrical and mechanical) should primarily have an engineering d: sign background, such as from an architect-engineer firm with experience in design and system operational requir:ments. The specialists should also be familiar with installation and surveillance testing of equipment along with cogniz:nce of how site engineering and operations organizations function. The specialists should be thoroughly familiar with NRC regulations and inspection methodology. Also, the specialists shoul_d be familiar with the regulatory process, and should be able to develop a list of regulatory commitments from docketed licensee correspondence for the plant

syst:m(s) selected for review. The specialists will then be required to verify implementation of the licensee's commitments and assess the effectiveness of the licensee's actions.

It shall be the responsibility of the contractor to assign technical staff, employees, and subcontractors, who have the required educational background, experience, or combination thereof, to meet both the technical and regulatory objectives of the work specified in this. Statement Of Work (SOW). The NRC will rely on representation made by the contractor conceming the qualifications of the personnel proposed for assignment to this task order including assurance that all i

inf rmation contained in the technical and cost proposals, including resumes and conflict of interest disclosures, is cccur"te and truthful.

WORK REQUIREMENTS AND SCHEDULE The contractor shall provide the qualified specialists, and the necessary facilities, materials, and services to assist the NRC ttaff in preparing for, conducting, and documenting the inspection activities and findings. The Technical Monit:r/ Team Leader for this task is Martin Farber. The Technice Monitor may issue technical instructions from time to tim 3 during the duration of this task order. Technicalinstructions must be within the general statement of work stated in this t sk order and shall not constitute new assignments of work or changes of such nature as tojustify an adjustment in cost or period of performance. The contractor shall refer to the basic contract for further information and guidance on eny technical directions issued under this task order.

Any modifications to the scope of work, cost or period of performatice of this task order must be issued by the Contracting Officer and will be coordinated with the NRR Project Officer. Specific tasks under this task order are:

Task Schedule Completion 1.

Provide QA oversight of the licensee's On-site inspection oversight is to take place activities including the process for the weeks of March 29 - April 2; determining the operability of designated April 5 - 9; April 19 - 23; and April 26 - 30, safety systems. Provide an assessment 1999 at the D.C. Cook site. April 12 - 16, of the adequacy of licensee's activities.

1999 is designated as in-office review at the contractors' home offices.

Prepare the inspection report.

Documentation of inspection will tak'e place at the contractors' home offices the week of May 3 - 7,1999 with the inspection report due on May 10,1999.

NOTE: Prior to the start of on-site preparation, the contractor's staff is required to be available to coordinate inspection aspects, such as travel logistics, with the Team Leader.

REPORT REQUIREMENTS Technical Reco_r1 During Tasks 1, the contractor's specialists shall provide daily reports to the NRC Team Leader. The format and scope of this r: port shall be as directed by the NRC Team Leader.

At the completion of Task 1 (prior to the inspection team's exit meeting with the licensee), the contractor's specialists shall provide a draft inspection report input to the NRC Team Leader. The format and scope shall be as directed by the NRC Team Leader. Typically, this input will consist of a handwritten summary of the specialist's inspection findings.

I At th2 completion of Task 2, the contractor shall deliver the final inspection report input (feeder report) to the NRC Project Officer (original and one copy) with one hard copy and one computer diskette versic,.1 (Wordperfect 6.1/8.0 or other IBM PC compatible software acceptable to the NRC Team Leader) to the NRC Team Leader. The format and scope of the final riport inputs shall be in accordance with the guidance in NRC Inspection Manual Chapter 0610 or as directed by ths NRC Team Leader.

A specillist's feeder report will serve as documentation of the specialist's inspection activities, effort, and findings, and will be used by the NRC Team Leader for the preparation of the NRC's inspection report. The form and scope of the final report input shall be in accordance with the guidance in NRC Inspection Manual Chapter 0610 or as directed by the NRC Term Leader. As a minimum, each specialist's report input shall include the following:

o identity of the individuals (name, company, and title) that provided information to the specialist during the inspection.

5-For each area inspected, a description of the activities and general findings and conclusions reached regarding o

the adequacy of the area.

For each area with a concern or findings, a discussion of the concems or findings with technical bases.

o NOTE: The contractor is not required to undertake any further efforts toward report finalization. For example, man:gement review of the feeder report beyond its submittal to the NRC Team Leader and Project Manager is not needed.

Business Letter Report Thn contractor shall provide monthly progress reports in accordance with the requirements of the basic contract.

MEETINGS AND TRAVEL For estimating purposes, the following meetings and travel are anticipated:

Four, two-person,5-day trips to the plant site near Benton Harbor, MI to conduct oversight of the licensee's activities (March 29 - April 2; April 5 - 9; April 19 - 23; and April 26 - 30,1999).

The contractor's staff shall coordinate all travel arrangements in advance with the NRC Team Leader.

NRC FURNISHED MATERIAL Docum:nts required to prepare for the inspection will be provided by the NRC Team Leader.

OTHER APPLICABLE INFORMATION Th3 work specified in this SOWis 100% licensee fee recoverable. The contractor shall provide fee recovery information in ths monthly progress repor's in accordance with the requirements of the basic contract.

j Th3 contractor's specialists assigned to this task order will have to be badged for unescorted access privilege at the plant sits. Th3 contractor shall provide all documentation required for badging (as identified by the NRC Team Leader) at the plant sits. Questions concerning badging and the plant site access shall be addressed to the NRC Technical Monitor.
