Dear Mr. Seeley:
As requested, we have reviewed the proposed revisions to Parts A, C, D, and E of the State of Ma'ne Rules Relating to Radiation Protection, dated January 1,1999. The proposed revisions were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts 20,30, and
- 34. We discussed our review of these regulations with Mr. Jay Hyland on March 8,1999.
As a result of our review, we have five comments that have been identified in the enclosure.
Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that a State regulation meets the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final State regulation. However, we have determined that if your proposed regulations were adopted incorporating the comments and without other significant change, they would meet the compatibility and health and safety categories established in OSP Procedure SA-200 (formerly B.7).
W6 equest that when the proposed regulations are adopted and published as final regulations, a copy of the as published" regulations be provided to us for review. As requested in OSP Procedure SA 201 - Review of State Reaulations (November 10,1998), please highlight the final changes and send one copy in a computer readable format, if possible.

D.62.C.(3) 20.1403(c)(3) Criteria for license termination under restricted use -
statement of intent from govemment licensees.
We recommend that the reference to " Federal" licensees be deleted.

34.2 Definition: radiographer The proposed definition differs from the NRC definition, possibly due to an editorial error. As currently written, the proposed definition does not appear to require the attendance of the radiographer when supervising industrial radiographic operations, and therefore would not meet the essential objective. We recommend that the intended wording of the proposed definition be verified.
C E.9.C.(3) 34.27(c)(3)
Leak testing and replacement of sealed sources The proposed rule omits text found in the NRC rule, possibly due to an editorial error. Although the rule as currently written meets the essential objective, we recommend that the intended wording of the proposed rule be verified.

Leak testing and replacement of sealed sources We recommend that the word " agency" not be changed to
" Commission" as in the proposed rule.
A-A.2.A(74) 20.1003 Definition: Occupational dose Occupational dose is a fundamental concept of radiation protection. A uniform definition of occupational dose, used by all regulatory jurisdictions, is vital. We strongly recommend that a definition essentially identical to the following be adopted in place of the definition in the proposed rules.
" Occupational dose means the dose received by an individual in the course of employment in which the individual's assigned duties involve exposure to radiation or to radioactive material from licensed and unlicensed sources of radiation, whether in the possession of the licensee or other person. Occupational dose does not include dose received from background radiation, from any medical administration the individual has received, from eFpDsure to individuals administered radioactive material and released in accordance with 10 CFR 35.75, from voluntary participation in medical research programs, or as a member of the public."
