The Cleveland Electric Illuminating Company (Perry Nuclear Power Plant, Units 1 and 2)
Docket Nos. 50-440 and 50-441./,
Gentlemen:
In its April 8, 1986 Memorandum and Order, the Appeal Board established the schedule for filing prepared testimony in the forthcoming exploratory hearing.
Testimony of witnesses for Applicants and the Staff must be received by the Appeal Board by April 28, with the exception that testimony by Drs.
Hinze and Alexander (should they be available as witnesses) must be received no later than May 5.
Applicants requested ad-ditional time for Drs. Hinze and Alexander because of their ex-tensive academic commitments and their participation in the Charleston, South Carolina seismological conference scheduled for late April.

Y SH Aw, PITTM AN, PoTTs & TROWBRIDGE A PARTNER $mp INCLUDING PROFES$i0N AL CORPORATIONS Messrs. Rosenthal, Johnson and Wilber April 11, 1986 Page Two Subsequent to the April 3 conference call at which the schedule for submitting testimony was discussed, Professor Pradeep Talwani (Applicants' consultant on the issue of well-induced seismicity) requested that we seek from the Appeal Board an extension of time until May 5 to submit his testimony.
Professor Talwani indicated that his responsibilities as Chair-man of the Charleston conference would severely restrict the amount of time he would have to prepare written testimony.
An-other matter which arose subsequent to the April 3 conference call which affects the time needed by Professor Talwani to pre-pare his testimony is the need to address matters raised in the statement presented at the April 8 Congressional hearings by Professor Moid Ahmad (see my letter of April 9 transmitting the Congressional testimony).
For these reasons, Applicants respectfully request that the April 8 Memorandum and Order be modified to permit Profes-sor Talwani's testimony to be received by the Appeal Board no later than May 5.
Ohio Citizens for Responsible Energy and the NRC Staff have no objection to the requested extension.
Very truly yours,
)i 9
